At the request of Clayton FM Partnership ("petitioner"), permittee of Station KFGA- FM, Channel 300A, Clayton, Louisiana, the Commission has before it the Notice of Proposed Rule Making and Order To Show Cause, 12 FCC Rcd 1914 (1997), proposing the substitution of Channel 257A for Channel 300A at Clayton, Louisiana, and modification of Station KFGA-FM's construction permit to reflect the alternate Class A channel. An Order to Show Cause was issued to Little River Radio Company ("Little River"), licensee of Station KJNA-FM, Jena, Louisiana, proposing the substitution of Channel 274A for Channel 257A and the modification of Station KJNA-FM's license to specify operation on the alternate Class A channel. Petitioner filed comments reiterating its intention to apply for Channel 257A at Clayton and to reimburse Little River for all reasonable expenses incurred in changing its channel. No other comments were filed. 2. We believe the public interest would be served by adopting petitioner's proposal since it would enable Station KPEL-FM, at Erath, Louisiana, to implement Class Cl facilities. This would also permit Station KJNA-FM at Jena, Louisiana, to improve its facilities from its present three kilowatts to six kilowatts. Channel 257A and Channel 274A can be allotted to Clayton and Jena, respectively, in compliance with the Commission's minimum distance separation requirements. Channel 257A can be allotted to Clayton at the transmitter site specified in petitioner's construction permit. Channel 274A can be substituted for Channel 257A at Jena and can be used at Station KJNA-FM's licensed site. 3. Accordingly, pursuant to the authority contained in Sections 4(i),5(c)(1), 303(g) and (r) and 307(b) of the Communications Act of 1934, as amended, and Sections 0.61, 0.204(b) and 0.283 of the Commission's Rules, IT IS ORDERED, That effective September 15, 1997, the FM Table of Allotments, Section 73.202(b) of the Commission's Rules, IS AMENDED, with respect to the communities listed below, to read as follows: City Channel No. Clayton, Louisiana 257A Jena, Louisiana 274A 4. IT IS FURTHER ORDERED, That pursuant to Section 316(a) of the Communications Act of 1934, as amended, the construction permit of Clayton FM Partnership for Station KFGA-FM, Clayton, Louisiana, IS MODIFIED to specify operation on Channel 257A in lieu of Channel 300A , subject to the following conditions: (a) Nothing contained herein shall be construed as authorizing any change in Station KFGA-FM's construction permit, BPH-940113MD, except the channel as specified above. Any other changes, except those so specified under Section 73.1690 of the Rules, require prior authorization pursuant to an application for construction permit (FCC Form 301). (b) Program tests may be conducted in accordance with the provisions of Section 73.1620 of the Rules, PROVIDED the transmission facilities comply in all respects with construction permit BPH-940113MD, except for the channel as specified above and a license application (FCC Form 302) is filed within 10 days of commencement of program tests. 5. IT IS FURTHER ORDERED, That pursuant to Section 316(a) of the Communications Act of 1934, as amended, the license of Little River Radio Company for Station KJNA-FM, Jena, Louisiana, IS MODIFIED to specify operation on Channel 274A in lieu of Channel 257A , subject to the following conditions: (a) Nothing contained herein shall be construed as authorizing any change in Station KJNA-FM's license, BLH-7168, except the channel as specified above. Any other changes, except those so specified under Section 73.1690 of the Rules, require prior authorization pursuant to an application for construction permit (FCC Form 301). (b) Program tests may be conducted in accordance with the provisions of Section 73.1620 of the Rules, PROVIDED the transmission facilities comply in all respects with license BLH-7168, except for the channel as specified above and a license application (FCC Form 302) is filed within 10 days of commencement of program tests. 6. IT IS FURTHER ORDERED, That the Secretary shall send a copy of this Report and Order by Certified Mail, Return Receipt Requested, to the licensee of Station KJNA-FM, as follows: Little River Radio Company, P.O. Box 1319, Columbia, Louisiana 71418. 7. IT IS FURTHER ORDERED, That this proceeding IS TERMINATED. 8.
