Before the Commission for consideration is the Notice of Proposed Rule Making (Notice), 11 FCC Rcd 12642 (1996), issued in response to a petition for rule making filed by Rick L. Murphy ("petitioner") proposing the allotment of Channel 230C3 to Parker, Arizona, as that community's second local FM transmission service. Petitioner filed supporting comments in response to the Notice. No other comments were received. 2. In view of the interest expressed in providing a second local FM transmission service to Parker, Arizona, we will allot Channel 230C3 to that community, as requested. 3. As stated in the Notice, Channel 230C3 can be allotted to the Parker in conformity with the minimum distance separation requirements of Section 73.207(b)(1) and (3) of the Commission's Rules, without a site restriction, utilizing the city reference location at coordinates 34-08-48 and 114- 17-12. Additionally, as Parker is located within 320 kilometers (199 miles) of the U.S.-Mexico border, the Commission obtained concurrence of the Mexican government to the proposal. 4. Accordingly, pursuant to the authority contained in Sections 4(i), 5(c)(1), 303(g) and (r) and 307(b) of the Communications Act of 1934, as amended, and Sections 0.61, 0.204(b) and 0.283 of the Commission's Rules, IT IS ORDERED, That effective September 2, 1997, the FM Table of Allotments, Section 73.202(b) of the Commission's Rules, IS AMENDED with respect to Parker, Arizona, as follows: CityChannel No. Parker, Arizona230C3, 257C2 5. IT IS FURTHER ORDERED, That this proceeding IS TERMINATED. 6. The window period for filing applications for Channel 230C3 at Parker, Arizona, will open on September 2, 1997, and close on October 3, 1997. 7.
