The Commission has before it for consideration the Notice of Proposed Rule Making, DA97-719, Released April 18, 1997, issued in response to a petition filed by Gideon Radio Company ("Gideon Radio"). The Notice proposed the allotment of Channel 280A to Gideon, Missouri, as that community's first local FM broadcast service. Gideon Radio filed comments reaffirming its interest in the allotment of Channel 280A at Gideon. No other comments were received at the Commission in response to the Notice. 2. We believe the public interest would be served by allotting Channel 280A to Gideon, Missouri, as it will provide the community with its first local FM broadcast service. Channel 280A can be allotted to Gideon, Missouri, in compliance with the minimum distance separation requirements of the Commission's Rules provided there is a site restriction 12.9 kilometers (8 miles) northeast of the community. The site restriction will prevent a conflict with Station KXOQ, Channel 282A, Kennett, Missouri, and to Station WTNV, Channel 281C1, Jackson, Tennessee. Although there is a short spacing to Station KPOC-FM, Channel 280A, Pocahontas, Arkanasas, the license for Station KPOX-FM has been modified to specify operation on Channel 281A in lieu of Channel 280A (PBPH-951205IF). 3. Accordingly, pursuant to the authority contained in Sections 4(i), 5(c)(1), 303(g) and (r) and 307(b) of the Communications Act of 1934, as amended, and Sections 0.61, 0.204(b) and 0.283 of the Commission's Rules, IT IS ORDERED, That effective February 2, 1998, the FM Table of Allotments, Section 73.202(b) of the Commission's Rules, IS AMENDED for the community listed below, as follows: Community Channel Number Gideon, Missouri 280A 4. IT IS FURTHER ORDERED, That the Secretary of the Commission shall send by Certified Mail, Return Receipt Requested, a copy of this Order to the following: Scott Media Services Station KPOC-FM P. O. Box 508 Pocahontas, Arkansas 72455 5. A filing window for Channel 280A at Gideon, Missouri, will not be opened at this time. Instead, the issue of opening a filing window for this channel will be addressed by the Commission in a subsequent order. 6. IT IS FURTHER ORDERED, That this proceeding IS TERMINATED. 7.
