Before the Commission for consideration is the Notice of Proposed Rule Making, (Notice), 12 FCC Rcd 1946 (1997), issued in response to a petition for rule making filed by Topaz Enterprises, Inc. ("petitioner"), proposing the allotment of Channel 253A to Orofino, Idaho, as that community's second local FM transmission service. Petitioner filed supporting comments in response to the Notice. No other comments were received. 2. In view of the interest expressed in providing an additional local FM service to Orofino, Idaho, we will allot Channel 253A to that community, as requested. 3. As stated in the Notice, Channel 253A can be allotted to Orofino consistent with the minimum distance separation requirements of Section 73.207(b)(1) and (2) of the Commission's Rules, without a site restriction, utilizing city reference coordinates 46-28-48 and 116-15-00. Additionally, as Orofino is located within 320 kilometers (199 miles) of the Canadian border, the Commission obtained the concurrence of the Canadian government to the proposal. 4. Accordingly, pursuant to the authority contained in Sections 4(i), 5(c)(1), 303(g) and (r) and 307(b) of the Communications Act of 1934, as amended, and Sections 0.61, 0.204(b) and 0.283 of the Commission's Rules, IT IS ORDERED, That effective August 4, 1997, the FM Table of Allotments, Section 73.202(b) of the Commission's Rules, IS AMENDED with respect to Orofino, Idaho, as follows: City Channel No. Orofino, Idaho 237C3, 253A 5. IT IS FURTHER ORDERED, That this proceeding IS TERMINATED. 6. The window period for filing applications for Channel 253A at Orofino, Idaho, will open on August 4, 1997, and close on September 4, 1997. 7.
