The Commission has before it for consideration the Notice of Proposed Rule Making, 12 FCC Rcd 1268 (1997), proposing the allotment of Channel 227A to Glen Arbor, Michigan, as that community's third FM broadcast service. The Notice was issued in response to a petition filed by Arborland Broadcasting Company ("Arborland"). Arborland filed comments reiterating its intention to apply for Channel 227A at Glen Arbor. No other comments were received at the Commission in response to this proposal. 2. We believe the public interest would be served by allotting Channel 227A to Glen Arbor, Michigan, since it will provide the community with additional broadcast service. As indicated in the Notice, Channel 227A can be allotted to Glen Arbor in compliance with the minimum distance separation requirements of the Commission's Rules provided there is a site restriction 7.9 kilometers (4.9 miles) south of the community. The site restriction will prevent a short spacing to Station WBCM, Channel 228C2, Boyne City, Michigan. Since Glen Arbor is located within 320 kilometers (200 miles) of the U.S.-Canadian border, concurrence of the Canadian government has been obtained for this allotment. 3. Accordingly, pursuant to the authority contained in Sections 4(i), 5(c)(1), 303(g) and (r) and 307(b) of the Communications Act of 1934, as amended, and Sections 0.61, 0.204(b) and 0.283 of the Commission's Rules, IT IS ORDERED, That effective June 23, 1997, the FM Table of Allotments, Section 73.202(b) of the Commission's Rules, IS AMENDED for the community listed below, as follows: Community Channel Number Glen Arbor, Michigan 227A, 238C2, 251C3 4. The window period for filing applications for Channel 227A at Glen Arbor, Michigan, will open on June 23, 1997, and close on July 24 , 1997. 5. IT IS FURTHER ORDERED, That this proceeding IS TERMINATED. 6. For further information concerning the above, contact Kathleen Scheuerle, Mass Media Bureau, (202) 418-2180.
