The Commission considers herein the Notice of Proposed Rule  s4O-Making, 9 FCC Rcd 3273 (1994), issued in response to a petition filed by R. J. Miller ("petitioner") proposing the allotment of Channel 244A to Pine Hill, Alabama, as that community's first local aural transmission service. Petitioner filed comments in support of the  s4-proposal.o s4"-#d `7#эPetitioner also requests that as the initiating proponent to provide a first local aural transmission service to Pine Hill, Alabama, that he be awarded a preference at the application level, should Channel 244A be allotted to the community, as requested. Although a proposal is before the Commission to provide a "finder's preference" to petitioners that have taken the initiative and burden of introducing new service to a community, no final  s4 -action has been taken on the request. See Reexamination of the Policy  s4-Statement on Comparative Broadcast Hearings (GC Docket No. 9252), 7 FCC Rcd 2664 (1992).  No other comments were received. 2. We believe the public interest would be served by allotting Channel 244A to Pine Hill, Alabama, since it could provide a first local aural transmission service to the community.  s4-8Engineering Analysis  s4#-3. As indicated in the Notice, Channel 244A can be allotted to Pine Hill consistent with the minimum distance separation   requirements of Section 73.207(b)(1) of the Commission's Rules, provided the transmitter is located at least 6.2 kilometers (3.9 miles) northwest of the community at coordinates North Latitude 320138 and West Longitude 873723. The site restriction is necessary to avoid a shortspacing to the authorized site of Station WJUS(FM), Channel 243C, Fort Walton Beach, Florida, at coordinates North Latitude 304504 and West Longitude 864238. 4. Accordingly, pursuant to the authority contained in Sections 4(i), 5(c)(1), 303(g) and (r) and 307(b) of the Communications Act of 1934, as amended, and Sections 0.61, 0.204(b) and 0.283 of the Commission's Rules, IT IS ORDERED, That effective , 1995, the FM Table of Allotments, Section 73.202(b) of the Commission's Rules, IS AMENDED to include Pine Hill, Alabama,"!o0*0*0**" as follows:  s4N- City Channel No. Pine Hill, Alabama 244A 5.
