Because the material aired at a time when  xkthere was a reasonable risk that children may have been in the audience, it is legally actionable. Thus,  xit appears that on August 2, 1997, Station KUPDFM violated 18 U.S.C.  1464 by airing indecent programming.  xAccordingly, pursuant to Section 503(b) of the Communications Act of 1934, as amended, Tempe Radio,  x[Inc., is hereby advised of its apparent liability for a forfeiture of Two Thousand Dollars ($2,000), for its  xapparent violation of 18 U.S.C.  1464 on August 2, 1997.
