Report No. MM 95-58MASS MEDIA ACTION July 19, 1995 FCC GRANTS WAIVER OF ONE-TO-A-MARKET- RULE TO FLINN BROADCASTING CORPORATION The FCC granted a waiver of 47 C.F.R., Section 73.3555(c), of the Commission's one-to-a-market rule to Flinn Broadcasting Corporation (Flinn) for station KFTH(FM), Marion, Arkansas. Flinn, the licensee of WFBI-TV, Memphis, TN, and two Memphis-area radio stations, WNWZ(AM) and WHBQ(AM), proposed to acquire KFTH(FM), Marion, Arkansas. Because of the Grade A contour of WFBI-TV encompasses the entire community of Marion, grant of the subject transfer of control application would create a new TV/radio combination that violated the one-to-a-market rule. The FCC recommended that Flinn's application for assignment of license and the related request for a waiver of the one-to-a-market rule be granted based on a case-by-case analysis. The waiver request demonstrated that KFTH(FM) operated at a loss in 1992, 1993, 1994 and the first half of 1995, and that the proposed consolidation of the stations' staff and production facilities would permit Flinn to operate KFTH(FM) with significant cost savings. Flinn also demonstrated that the combination will lead to an enhancement of KFTH(FM)'s news and public affairs programming. The waiver request showed that Flinn's combination involves technically modest stations. In addition, given the significant number of "voices" in the Memphis market, Flinn's acquisition of KFTH(FM) will not result in undue concentration of ownership control. Thus, the addition of this FM station to Flinn's existing operations would not appear to unduly affect competition and diversity. Action by the Commission July 17, 1995 by MO&O (FCC 95-299).
