Report No. MM 96-7 MASS MEDIA ACTION February 6, 1996 NAACP DENIED RECONSIDERATION OF COMMISSION'S DECISION TO RENEW THE LICENSE OF KDYL/KSFI-FM, SALT LAKE CITY, UT The Commission has denied the petition for reconsideration filed by the Idaho/Nevada/Utah State Conference of Branches of the NAACP. The NAACP argued that the failure of KDYL/KSFI-FM, Salt Lake City, UT, to implement an effective EEO program was evidence of discrimination which should be resolved in a hearing. The NAACP also contended that the licensee's arguments that its format and pay scales have affected the stations' ability to attract minority applicants reflect discriminatory intent. The Commission found that the NAACP had not shown a material error or omission, or raised additional facts not previously known or existing. Moreover, the Commission concluded that there was no evidence of discrimination, and the licensee was correctly found to be qualified. The Commission also found that the licensee's explanations as to its alleged obstacles with recruiting minority applicants did not reflect discriminatory intent. Accordingly, the Commission found no basis upon which reconsideration should be granted. Action by the Commission December 15, 1995, by Memorandum Opinion and Order (FCC 95-510).
