NEWSReport No. MM 95-88 MASS MEDIA ACTION September 1, 1995 FORFEITURE ASSESSED AGAINST WQPW (FM), VALDOSTA, GA, UPHELD The Commission has affirmed its decision that WQPW (FM), Valdosta, GA, forfeit $15,000 for repeated violations of the Commission's EEO (Equal Employment Opportunity) rule. WQPW (FM) argued that a forfeiture was inappropriate because the Notice of Apparent Liability concluded that there was no evidence of discrimination. WQPW (FM) also argued that the Commission had misread the station's financial information and that the station's ability to pay had been adversely affected by significant losses. The Commission rejected WQPW's arguments, stating that the forfeiture was based on the station's repeated failure to comply with provisions of the Commission's rules. The Commission also disagreed with WQPW's contention that the station's financial documents were misread, stating that the documents did not prove that the station is unable to pay the forfeiture.
