NEWSReport No. MM 95-70 MASS MEDIA ACTION July 27, 1995 RENEWAL OF WEAR-TV, PENSACOLA, FL, AND RENEWAL AND TRAN SFER OF CONTROL OF NINE LICENSES IN FIVE STATES UPHELD; NAL ISSUED The Commission has denied the NAACP's petition for reconsideration of the Commission's decision approving the transfer of control from James M. Hoak, Jr., to Heritage Media Corporation of the licensees of Stations WEMP(AM)/WMYX-FM, Milwaukee, WI, WRTH(AM)/WIL-FM, St. Louis, MO, WBBF(AM)/WBEE-FM, Rochester, NY, and KULL(AM)/KRPM-FM, Tacoma, WA; and the renewal and transfer of control of the licensee of Station WEAR-TV, Pensacola, FL. In seeking reconsideration, the NAACP did not allege any facts not previously considered, but argued that the Commission failed to give the NAACP statistical evidence regarding discrimination sufficient consideration, and failed to sufficiently investigate terminations of minorities. The Commission, however, fully considered the NAACP's statistical evidence in reaching its decision, and determined that the statistical evidence did not provide sufficient grounds to order a hearing. The Commission conducted a complete investigation of the stations and found no evidence of discrimination. However, it admonished stations WBBF(AM)/WBEE-FM and WEAR-TV for failing to contact minority sources whenever a vacancy occurred, and issued a $6,250 forfeiture and imposed reporting conditions on the licensee of Stations KULL(AM)/KRPM-FM for deficient recruitment efforts. As the NAACP's arguments and evidence had been fully considered, and the stations' records fully investigated, the Commission found that reconsideration was not warranted.
