NEWSReport No. MM 95-92 MASS MEDIA ACTION September 11, 1995 COMMISSION AFFIRMS DECISION TO RENEW LICENSES OF STATIONS WKZQ(AM)/ WKZQ-FM, MYRTLE BEACH, SC The Commission has affirmed its decision to renew the licenses of stations WKZQ(AM)/WKZQ-FM, Myrtle Beach, SC, subject to short term renewals, reporting conditions, and a forfeuture of $10,000. The sanctions were imposed because the Commission found the licensee's EEO efforts were deficient. A Petition for Reconsideration of that decision was filed by the South Carolina State Conference of Branches of the NAACP (NAACP) and the National Black Media Coalition (NBMC). In affirming its earlier decision, the Commission denied the Petition for Reconsideration with respect to the NAACP and dismissed it with respect to the NBMC. The Commission stated that "reconsideration is only appropriate where the petitioner shows either a material error or omission in the original order or raises additional facts not known or not existing until after the petitioner's last opportunity to present such matters." Applying this standard, the Commission concluded that reconsideration was not warranted with respect to its disposition of the license renewal applications of WKZQ(AM)/WKZQ-FM. The Commission found no reason to change its decision stating that "reconsideration will not be granted for the purpose of debating matters on which we have already deliberated and spoken."
