Report No. MM-823 MASS MEDIA ACTION April 28, 1994 SIX RADIO STATIONS IN NEW YORK GRANTED LICENSE RENEWALS, SUBJECT TO SHORT TERM RENEWAL, FORFEITURES, AND REPORTING CONDITIONS Following review of their respective EEO (Equal Employment Opportunity) programs, the Commission has granted, subject to sanctions and remedies, the license renewal applications to the following New York licensees: Buckley Broadcasting Corporation, for stations WSEN(AM)/WSEN-FM; Buckley-WOR Broadcasting Corporation, for station WOR(AM); Interstate Broadcasting Company, Inc., for stations WQXR(AM)/WQXR-FM; and Group W Radio, Inc., for station WINS(AM). The National Association for the Advancement of Colored People (NAACP) petitioned the applications of WSEN(AM)/WSEN-FM and the National Hispanic Media Coalition (NHMC) petitioned the applications of the other licensees. The Commission has renewed the licenses of WSEN(AM)/WSEN-FM for a short term subject to reporting conditions and a Notice of Apparent Liability (NAL) for $25,000. The sanctions are based on the licensee's failure to engage in recruiting efforts so as to attract an adequate pool of minority applicants for a substantial number of its 27 full-time jobs. Further EEO conduct indicating particular types of deficiencies also contributed to the imposed sanctions. In this regard, specific deficiencies include the licensee's failure to recruit for at least a third of its positions and inadequate efforts given the large number of hiring vacancies. The Commission has renewed the license of WOR(AM) subject to reporting conditions and an NAL for $23,750. The sanctions are based on the licensee's failure to engage in recruiting efforts so as to attract an adequate pool of minority applicants for a substantial number of its 14 full-time jobs. Further EEO conduct indicating a particular type of deficiency also contributed to the imposed sanctions. In this regard, the specific deficiency was the licensee's inadequate efforts given the large minority labor force. (over) - 2 - The Commission has renewed the licenses of WQXR(AM)/WQXR-FM subject to reporting conditions. The Commission said that based on its review of the record, it found that grant of the renewals would be in the public interest. It said that the licensee made efforts to recruit minorities and attracted and hired minority applicants during the license term. However, the licensee failed to self- assess its program adequately regarding Hispanics, who are significantly represented in the New York labor force. Despite acknowledged recruitment difficulties with Hispanics, the licensee used few recruitment sources likely to attract Hispanic applicants. The Commission has renewed the license of WINS(AM) subject to reporting conditions. The Commission said that based on its review of the record, it found that grant of the renewal would be in the public interest. It said that the licensee made efforts to recruit minorities and attracted and hired minority applicants during the license term. However, the licensee failed to self-assess its program adequately. Notwithstanding its minority hiring rate, the Commission found that the licensee failed to adequately evaluate its efforts to attract Hispanics, who are significantly represented in the New York labor force.
