In the Application of WCS Radio, Inc. for Launch and Operating Authority in the Digital Audio
Radio Service (File No. SAT-LOA-19981112-00085; Call Sign S2360) and (File No. SAT-LOA-
                19981112-00086; Call Sign S2361)
                                
     On November 13, 1998, WCS Radio, Inc. ("WCSR") filed an application seeking authorization to
construct, launch, and operate two communications satellites in the digital audio radio service ("DARS"). 
This application was put on Public Notice on December 14, 1998.

     Ex Parte Status of this Proceeding.  The application captioned above is restricted under the
Commission's ex parte rules.  See  1.1200(d) and 1.1208.  We hereby redesignate this application
captioned above as a "permit but disclose" proceeding pursuant to Section 1.1200(a) of the Commission's
rules.  47 C.F.R.  1.1200(a), 1.1206 and 1.1208, Note 2.  We conclude that such treatment would best
serve the public interest, in light of the intricate international coordination issues and the interrelated legal
and technical issues involving spectrum sharing with the United States DARS systems and terrestrial WCS
systems that are raised by this application.  Accordingly, effective February X, 1999, ex parte
presentations in this proceeding are subject to the disclosure requirements set forth in Section 1.1206 of the
Commission's rules.  47 C.F.R.  1.1206.

     This action is taken pursuant to authority found in Sections 4(i) and 303 of the Communications
Act of 1934, as amended, 47 U.S.C.  154 (i) and 303; and pursuant to Sections 0.51, 0.241, 0.261 and
1.1200(a) of the Commission's Rules.  See 47 C.F.R.  0.51, 0.241, 0.261 and 1.1200(a).   

     The application and related filings will be available for public inspection in the International
Reference Center, Room 102, 2000 M Street, N.W., Washington, D.C.  20554.
