TerraStar, Inc. has filed a Request for Declaratory Ruling seeking clarification of Section 25.104 of the
Commission's rules regarding preemption of local zoning restrictions.  In particular, TerraStar is seeking
a declaration that its new C-band earth station lies within the meaning of the Commission's one meter
presumption rule.  TerraStar's StarVideo system consists of three adjacent parabolic antennas positioned
horizontally along a small support beam.  Each dish is approximately 0.53 meters in diameter.  

Comments or petitions on TerraStar's request may be filed on or before July 17, 1996.  Responses may
be filed on or before August 1, 1996.
