Washington, D.C. 20554 Report No. I-8189 DA 96-1135 Released: July 17, 199 6 EX PARTE STATUS OF WAIVER REQUESTS FILED UNDER SECTION 64.1001 OF THE COMMISSION'S RULES The International Bureau issues this Public Notice, pursuant to 47 C.F.R.  1.1200(a), to clarify its practice in applying the Commission's ex parte rules to international carrier requests for waiver under Section 64.1001 of the rules, International Settlements Policy and Waivers, 47 C.F.R.  64.1001. The Commission's ex parte rules are contained in 47 C.F.R.  1.1200, et seq. The Bureau historically has treated requests for waiver filed under Section 64.1001 of the rules as non-restricted proceedings, in the same manner as Section 214(a) proceedings are treated. See 47 C.F.R.  1.1204(a)(11) &  1.1206(b)(8). Thus, once a waiver request filed under Section 64.1001 is formally opposed, ex parte presentations are permissible, but are subject to the disclosure requirements of Section 1.1206(a). Whether or not a formal opposition has been filed, informal objectors must comply with the disclosure requirements of Section 1.1206 with respect to their ex parte presentations at all times except where confidentiality is necessary to protect against possible reprisals. These Section 64.1001 waiver requests are subject to other relevant provisions of the ex parte rules in the same manner as Section 214(a) proceedings, including the Sunshine period prohibition contained in Section 1.1203 of the rules. The Bureau is issuing this Public Notice at this time because of numerous pending proceedings that involve requests for waiver under Section 64.1001 and to make clear that all such waiver requests will be treated as non-restricted proceedings unless the Bureau or Commission indicates otherwise.
