The newly created company will own and operate the satellites previously owned and operated by Inmarsat and will provide existing commercial and safety services. It is not to have the privileges and immunities bestowed on the current intergovernmental organization. Current Inmarsat contracts will be novated to Inmarsat Limited. Existing land earth station operators will distribute the services of the corporation pursuant to a Land Earth Station (LES) Operator Agreement with the company. The newly created company will retain the name "Inmarsat". An Initial Public Offering (IPO) is anticipated within two years. A residual intergovernmental organization (International Mobile Satellite Organization (IMSO), consisting of a small directorate, will be created to ensure that the new company continues to provide GMDSS (Global Maritime Distress and Safety Services). IMSO will not have any control over the operations or facilities of the new Inmarsat. Instead, IMSO will enter into a Public Services Agreement with Inmarsat Limited whereby the IMSO will have the ability to ensure that Inmarsat meets its obligations to provide GMDSS as set out in the agreement.  S '4.` ` Comsat and Stratos have filed applications to modify their existing land earth station licenses to change points of communication from Inmarsat to Inmarsat Limited in order to continue operation with those satellites upon transfer to Inmarsat Limited. In addition, Comsat has filed amendments to several pending applications to reflect operation with Inmarsat Limited satellites. Both Comsat and Stratos request special temporary authority to continue operations with the satellites being transferred to Inmarsat Limited pending Commission action on their underlying applications.  S'5.` ` No opposition or comments have been filed in connection with Comsat's or Stratos' applications of special temporary authority requests.  S@'Q Discussion ă  S'6.` ` We conclude that the public interest will be served by issuing a special temporary authority to assure continued operation of the earth stations listed in the Appendix with satellites transferred to Inmarsat Limited. This action will ensure continuation of existing land earth station operations pending Commission action on the underlying applications of Comsat and Stratos to modify their licenses to reflect the transfer of the satellites to Inmarsat Limited.  S'7.` ` We will take final action on the Comsat and Stratos applications after Congressional action on legislation to conform the International Maritime Satellite Telecommunications Act of 1978 to the Inmarsat privatization. Congressional action is necessary to authorize U.S. participation in IMSO and to eliminate provisions of the Maritime Satellite Act no longer necessary or relevant to the  S`'operation of Inmarsat Limited in the United States. Two bills are currently pending before Congress.`_M yO 'ԍXS.151, introduced on January 19, 1999, authorizes U.S. participation in the residual IGO and eliminates all other provisions of the Maritime Satellite Act relating to Comsat's participation in the old Inmarsat and U.S. government oversight of Comsat. S.376, introduced on February 4, 1999, is a comprehensive bill addressing both INTELSAT and Inmarsat privatization. The provisions in S. 376 on Inmarsat privatization are the same as those in S.151. Finally, H.R.1872 passed by the House last year in the previous Congress, also addressed Inmarsat privatization. H.R.1872 has not been reintroduced.(#Ɣ "`@0*&&((M" Pending enactment of new legislation, this special temporary authority permits continuation of operation of existing land earth stations in the United States pursuant to the terms of the LES Operating Agreement that will go into effect when Inmarsat is privatized on or about April 15, 1999. This STA will be renewable.  S8'8.` ` The authorizations here are temporary only and do not prejudice Bureau action on the underlying applications pursuant to any Congressional guidance in implementing legislation. The authorizations are subject to the condition that harmful radio interference shall not be caused to any other lawfully operated radio station, and operation(s) shall cease immediately upon notification of interference. Complaints of all radio interference shall be forwarded immediately to the Bureau, in writing.
