SPB-105 (DA 97-2201), SPB- 106, (DA 97-2202) Establishing Cut-Off Dates for Additional Applications in the Specific Ka-Band Frequencies ORDER Adopted: December 19, 1997 Released: December 19, 1997 By the Chief, Satellite and Radiocommunication Division: 1. With this Order we deny Norris Satellite Communications, Inc.'s (Norris) request for a thirty day extension of time in which to file new Ka-band satellite applications pursuant to the above-referenced Public Notices. 2. Norris asserts that in the short time frame following the release of the Public Notices, it has been unable to retain a qualified engineer who can finish the technical portion of its application in time to meet the December 22, 1997 cut-off deadline. Norris further asserts that a "minimal delay at this point will serve the public interest, convenience and necessity by allowing additional small business entrants to prepare and submit acceptable applications to provide satellite service." 3. We believe that Norris has not demonstrated an adequate public interest showing to justify an extension of the cut-off date. We believe it is in the public interest to maintain the filing date as December 22, 1997. Moreover, the sixty-eight day cut-off established is a reasonable amount of time for all parties to file acceptable applications. FEDERAL COMMUNICATIONS COMMISSION Thomas S.
