In May 1997, the International Bureau ("Bureau") acted on the first group of applications proposing to provide fixed-satellite service ("FSS") from geostationary-satellite orbit ("GSO") in the Ka-band. Specifically, the Bureau adopted an assignment plan that reflected the orbit location agreement that was reached by all fourteen GSO companies that had participated in the first Ka-band processing round. The Assignment Order also reflected that AT&T - one of the first round applicants - decided to withdraw its applications after the assignment agreement was reached. 2. In the Assignment Order, the Bureau noted that it would entertain requests for changes in the orbital assignment plan if the GSO licensees affected by the change agreed. We also noted that any alternative assignment arrangement must be presented within thirty days. The Bureau received several requests for reassignment, within the thirty day period, to those orbital locations vacated by the withdrawal of the AT&T applications. Lockheed Martin Corporation, Loral Space and Communications, Orion Network Systems, and PanAmSat Corporation all requested assignment to one or more of AT&T's vacated locations. CAI Wireless Corporation filed oppositions to the various requests for reassignment. The licensees seeking reassignment later reached agreement with respect to the reassignments. 3. To clarify the orbital locations that are available to parties proposing to file applications in the second Ka-band processing round, we issue, without opinion, this Order adopting a revised assignment plan. The opinion will follow within 30 days and will address all issues in the record. We believe that pursuant to Section 309 of the Communications Act, 47 U.S.C.  309, the public interest, convenience, and necessity will be served by adopting the reassignments reflected in Appendix A. 4. Accordingly, IT IS ORDERED that the Ka-band orbital assignment plan is revised as set forth in Appendix A. 5. IT IS FURTHER ORDERED that the assignment of any orbital location is subject to change by summary order of the Commission on 30 days notice and does not confer any permanent right to the use of the orbit or spectrum. 6. IT IS FURTHER ORDERED that for purposes of filing applications for review of these reassignments, the date of Public Notice shall be deemed as the date of release of the Bureau's Order setting forth the reasons for adopting these reassignments.
