MEMORANDUM OPINION, ORDER AND AUTHORIZATION Adopted: June 13, 1997Released: June 17, 1997 By the Chief, Telecommunications Division: 1.Teleport Transmission Company (TTC), Pacific & Eastern Data Transmission Services, Inc. (PEDTS) and Maritime Telecommunications Network, Inc. (MTN). pursuant to Section 214 of the Communications Act of 1934, as amended, submitted the above-captioned applications requesting authority to assign TTC's and PEDTS' Section 214 authorization to MTN. The applications were placed on public notice on May 2, 1997. No comments were received. 2.The applicants, all Colorado corporations, are certified international communications carriers which provide a variety of facilities-based and resale services between the United States and various overseas points. Applicants are seeking to assign only those authorizations which grant authority to provide facilities-based services via various non-U.S. licensed satellite systems, since MTN has been granted global authority pursuant to the Commission's new streamlined procedures. Applicants state that at present, the services encompassed in the authorizations to be assigned are made available to MTN by means of service agreements. Grant of the applications will allow MTN to provide the services directly and more efficiently. 3.Upon consideration of the applications and in view of the foregoing, we conclude that consent to assignment of TTC's and PEDTS' Section 214 authorizations to MTN will serve the public interest, convenience and necessity. 4.Accordingly, IT IS ORDERED that the applications, File Nos. I-T-C-97-235-AL and I-T-C-97-236-AL ARE GRANTED, and we consent to the assignment from TTC and PEDTS to MTN of their respective Section 214 authorizations. 5.IT IS FURTHER ORDERED that all terms and conditions of any Commission orders granting authority to TTC and PEDTS to provide common carrier services are now applicable to MTN. 6. IT IS FURTHER ORDERED, pursuant to Section 203 of the Communications Act, 47 U.S.C. 203, and Part 61 of the Commission's Rules, 47 C.F.R. Part 61, that MTN must continue to maintain tariffs for the services authorized in this Order. 7.IT IS FURTHER ORDERED that the MTN shall file the annual reports of overseas telecommunications traffic required by Section 43.61 of the Commission's Rules, 47 C.F.R. 43.61. 8. This Order is issued under Section 0.261 of the Commission's Rules and is effective upon adoption. Petitions for reconsideration under Section 1.106 or applications for review under Section 1.115 of the Commission's Rules may be filed within 30 days of the date of public notice of this Order (see Section 1.4(b)(2)).
