AMSC Subsidiary Corporation (AMSC) has applied to modify the milestone dates for its AMSC-1 satellite. No comments were filed on this application. For the reasons discussed below, AMSC's application, as modified, is granted. 2. AMSC was authorized to construct, launch and operate its AMSC-1 satellite in 1989. The authorization was modified in May 1993. AMSC's current milestone schedule for this satellite is: Construction Launch Completion AMSC-1 April 1994 December 1994 3. AMSC seeks an extension of time in which to complete construction and launch of its AMSC-1 satellite. AMSC asserts that this extension is necessary because unanticipated technical problems with the satellite's L-band antenna. Resolution of the problems is being hindered by a contractual dispute between the vendor and the manufacturer. Although alternatives are being explored, Hughes Aircraft Company, the prime contractor for construction of AMSC-1, indicated that the construction would be delayed a minimum of five months. In turn, the launch was rescheduled for mid-April 1995, to account for the delay in construction and weather delays at the launch site. Therefore, AMSC requests extensions of the authorized milestone dates. 4. Generally, extensions of implementation milestone dates are granted when the delay in implementation is due to circumstances beyond the control of the licensee. The circumstances presented by AMSC are consistent with this policy. AMSC has already commenced construction of the AMSC-1 satellite, construction is continuing, and the requested extensions are brief. Grant of this extension would serve the public interest. 5. Accordingly, pursuant to Section 0.261 of the Commission's rules on delegations of authority, 47 C.F.R.  0.261, IT IS ORDERED that Application File Nos. 29- DSS-MP-94 and 49-DSS-AMEND-94 ARE GRANTED and the milestone schedule as specified in AMSC Subsidiary Corporation, 8 FCC Rcd 4040 (1993), IS MODIFIED as follows: Construction Launch Completion AMSC-1 February 1995 April 1995 6.
