On May 27, 1999, the Commission adopted and released a Memorandum Opinion and Order (the "MO&O") in the Matter of Canyon Area Residents for the Environment Request for Review of Action Taken Under Delegated Authority on a Petition for an Environmental Impact Statement. The MO&O had affirmed a letter ruling, dated October 9, 1998, by the Chief of the Office of Engineering and Technology. The MO&O, inter alia, had found that the record did not establish that the proposed location of a transmission tower in an established antenna farm, which ordinarily would be categorically excluded from environmental processing requirements, would significantly affect historic properties requiring the FCC to "take into account" the tower's impact on such properties and afford the Advisory Council on Historic Preservation ("Council") a "reasonable opportunity to comment." See 16 U.S.C.  470f; see also 47 C.F.R.  1.1307(c). On June 3, 1999, the Council wrote the Commission, stating that the proposed tower potentially may affect three historic properties and requesting Commission review of the matter. On June 25, 1999, the Commission issued a Public Notice (DA 99-1211) announcing that the Commission would treat the Council's letter as a petition for reconsideration and soliciting comment on that portion of the MO&O that addressed the historic preservation concerns. Oppositions or comments were due July 23, 1999, and reply comments were due August 9, 1999. On July 15, 1999, the Lake Cedar Group LLC ("LCG") filed a Request for Extension of Time Within Which to File Comments on the Petition for Reconsideration. We have reviewed, and are hereby granting, LCG's request for extension of time for a period of thirty days. Accordingly, interested parties may file oppositions or comments, on the issue of historic concerns raised by the Council's letter, on or before August 23, 1999, and reply comments on or before September 9, 1999.
