DA 00-575 Released: March 15, 2000 COMMON CARRIER BUREAU SEEKS COMMENT ON THE PUBLIC SERVICE COMMISSION OF KENTUCKY'S PETITION FOR DELEGATION OF ADDITIONAL AUTHORITY TO IMPLEMENT NUMBER CONSERVATION MEASURES CC DOCKET: 96-98 NSD File No. L-00-08 Pleading Cycle Established COMMENTS: April 14, 2000 REPLY COMMENTS: April 28, 2000 On September 28, 1998, the Federal Communications Commission ("Commission") released an order in the matter of a Petition for Declaratory Ruling and Request for Expedited Action on the July 15, 1997 Order of the Pennsylvania Public Utility Commission Regarding Area Codes 412, 610, 215, and 717, and Implementation of the Local Competition Provisions of the Telecommunications Act of 1996, Memorandum Opinion and Order and Order on Reconsideration, FCC 98-224, CC Docket No. 96-98, NSD File No. L-97-42 (rel. September 28, 1998) ("Pennsylvania Numbering Order"). The Pennsylvania Numbering Order delegated additional authority to state public utility commissions to order NXX code rationing in jeopardy situations and encouraged state commissions to seek further limited delegations of authority to implement other innovative number conservation methods. On January 25, 2000, the Public Service Commission of Kentucky (Petitioner) filed a petition requesting additional delegated authority pertaining to number conservation measures in the State of Kentucky. The Petitioner specifically requests authority to: (1) enforce number assignment standards, including the reclamation of NXX codes, and thousand-number blocks within those codes; (2) implement mandatory thousands-block number assignments within Local Number Portability capable areas; (3) establish fill rates for growth codes that must be met before carriers may acquire additional codes; (4) require sequential number assignments by carriers; (5) require the submission by carriers of number utilization and forecast information; (6) audit carriers' use of numbering resources; and (7) accomplish other tasks necessary to perform the functions enumerated above. Petitioner states that it will use this additional authority to prolong the lives of the 270, 502, 606, and 859 area codes, and thus delay the necessity to provide additional area code relief within the State of Kentucky. We hereby seek comment on the issues raised in Petitioner's request for delegation of additional authority to implement the above number conservation measures.
