               IDAHO PUBLIC UTILITIES COMMISSION
              PETITION FOR RULEMAKING PURSUANT TO 
          SECTION 251(h)(2) OF THE COMMUNICATIONS ACT

     On November 23, 1998, the Idaho Public Utilities Commission (Idaho Commission) filed a
petition pursuant to section 251(h)(2) of the Communications Act of 1934, as amended (Act). 
The Idaho Commission requests the Commission to provide for the treatment of CTC Telecom,
Inc., a local exchange carrier (LECs) planning to offer telephone exchange service in Idaho, as an
incumbent local exchange carrier for purposes of section 251(c) of that Act.  The Idaho
Commission further requests that the Commission to provide for the treatment of all similarly
situated LECs as incumbent LECs for purposes of Section 251(c).  We will treat the Idaho
Commission's petition as a petition for rulemaking.

     Interested parties may file any comments regarding the Idaho Commission petition no later
than January 11, 1999, with the Secretary, FCC, at 445 Twelfth Street, S.W., Washington, D.C.
20554 or at 1919 M Street, N.W., Washington, D.C. 20554, from 4:00 p.m. to 5:30 p.m. 
Oppositions or responses to these comments and petitions may be filed with the Secretary, FCC,
no later than January 26, 1999.  All pleadings are to reference CC Docket No. 98-221. 
Interested parties should file an original and 12 copies of all pleadings.  An additional copy of all
pleadings must also be sent to Janice M. Myles, Common Carrier Bureau, FCC, Room 544, 1919
M Street, N.W., Washington, D.C.  20554, and to the Commission's contractor for public service
records duplication, International Transcription Services, Inc. (ITS), 1231 20th Street, N.W.,
Washington, DC  20036.  The Idaho Commission petition is available for inspection and copying
during normal business hours in the FCC's Reference Center, Room 239, 1919 M Street, N.W.,

be filed.  If multiple docket or rulemaking numbers appear in the caption of this proceeding,

     We will treat this proceeding as permit, but disclose for purposes of the Commission's ex

summary of the substance of the presentation and not merely a listing of the subjects discussed. 
More than a one or two sentence description of the views and arguments presented is generally
required.  See 47 C.F.R.  1.1206(b)(2), as revised.  Other rules pertaining to oral and written
presentations are set forth in section 1.1206(b) as well.  Interested parties are to file with the
Secretary, FCC, and serve Janice Myles and ITS, with copies of any written ex parte
