Washington, D.C. 20554 DA 97-2713 December 30, 1997 EX PARTE PRESENTATIONS IN CC DOCKET NO. 96-45 It has been brought to our attention that some confusion may have existed concerning certain oral presentations made during the last few weeks relating to universal service issues in this docketed rulemaking proceeding that may also have related to certain tariffs to be filed in the future. For this reason, we provide the following clarification. While discussions regarding future tariff filings were not required to be disclosed because no proceeding had been initiated, see 47 C.F.R.  1.1204(b)(3), oral ex parte presentations from private parties and the public regarding universal service issues within the scope of this proceeding (e.g., collection caps for federal universal service support mechanisms for schools and libraries and rural health care providers, timing of implementation of federal universal service support mechanisms and scope of billing disclosure issues) must be disclosed for the record, if not otherwise previously filed in the record by the person or entity involved, even if they also related to future tariff filings for which no disclosure was required. See 47 C.F.R.  1.1206(b)(2). Accordingly, any such persons or entities that made any such undisclosed oral ex parte presentations should file for the record a summary of any such presentations within three business days of this public notice. In addition, Commission personnel should file for the record a summary of any undisclosed oral ex parte presentations made by Members of Congress or their staffs, or an agency or branch of the Federal Government or its staff, regarding universal service issues within the scope of this proceeding that were of substantial significance and were clearly intended to affect the ultimate decision, as set forth in 47 C.F.R.  1.1206(b)(3).
