No. 73, Transmittal No. 2633 Raising Issues of Competitive Necessity Pleading Cycle Established CC Docket No. 97-158 CCB/CPD 97-67 COMMENTS: January 12, 1998 REPLY COMMENTS: January 22, 1998 On November 14, 1997, the Commission released an order concluding its investigation into Southwestern Bell Telephone Company's (SWBT's) tariff Transmittal No. 2633. In that order, the Commission rejected SWBT's transmittal on ground that the competitive necessity defense did not apply to Transmittal No. 2633. On December 15, 1997, Southwestern Bell Telephone Company (SWBT) filed a petition for reconsideration of this order. Interested parties may file comments on SWBT's petition for reconsideration no later than January 12, 1998. Replies are due January 22, 1998. When filing comments, interested parties should reference the internal file number: CCB/CPD 97-67. An original and four copies of all comments must be filed in accordance with Section 1.51(c) of the Commission's Rules, 47 C.F.R.  1.51(c). In addition, one copy of each pleading must be filed with International Transcription Service, Inc. (ITS), the Commission's duplicating contractor, at its office at 1231 20th Street, NW, Washington, D.C. 20036, and one copy with the Chief, Competitive Pricing Division, Room 518, 1919 M Street, N.W., Washington, D.C. 20554.
