The four new rate elements would allow Pacific Bell to assess a charge on wireless and wireline "N minus one" (N-1) telecommunications carriers that: (a) terminate unqueried interstate traffic into Pacific Bell's end offices but arrange for Pacific Bell to determine the routing information for the terminating customer, (b) terminate unqueried interstate traffic into Pacific Bell's tandem offices but arrange for Pacific Bell to determine the routing information for the terminating customer, (c) terminate unqueried interstate traffic into Pacific Bell's end offices but do not arrange for Pacific Bell to determine the routing information for the terminating customer, (d) terminate unqueried interstate traffic into Pacific Bell's tandem offices but do not arrange for Pacific Bell to determine the routing information for the terminating customer. Pacific Bell filed the petition under Section 69.4(g)(1)(ii) of the Commission's rules, which allows "[l]ocal exchange carriers subject to price cap regulation [to] establish one or more switched access rate elements for a new service upon approval of a petition demonstrating that [a]nother local exchange carrier has previously obtained permission to establish one or more rate elements identical to those proposed in the petition to offer the identical service." According to Pacific Bell, the Competitive Pricing Division, Common Carrier Bureau, granted Ameritech permission to establish identical rate elements and to provide the same service, namely, the performance of number portability queries for carriers that terminate interstate calls to Pacific Bell's network without the necessary routing information. Pacific Bell asserts, therefore, that the Commission should grant Pacific Bell's waiver petition in accordance with Section 69.4(g)(1)(ii) of the Commission's rules. Interested parties may file comments on Pacific Bell's waiver petition no later than December 19, 1997. When filing comments, interested parties should reference the internal file number: CCB/CPD 97-65. An original and four copies of all comments must be filed in accordance with Section 1.51(c) of the Commission's Rules, 47 C.F.R.  1.51(c). In addition, one copy of each pleading must be filed with International Transcription Service, Inc. (ITS), the Commission's duplicating contractor, at its office at 1231 20th Street, NW, Washington, D.C. 20036, and one copy with the Chief, Competitive Pricing Division, Room 518, 1919 M Street, N.W., Washington, D.C. 20554.
