AND THE CITY OF BOGUE, KANSAS AND THE CITY OF HILL CITY, KANSAS CCBPol 96-10 Released: November 6, 1997 On October 24, 1997, Classic Telephone, Inc. (Classic) and the City of Bogue, Kansas and the City of Hill City, Kansas (the Cities) filed petitions for reconsideration and/or clarification of the Commission's decision denying Classic's petition for emergency relief in this proceeding. Memorandum Opinion and Order, CCBPol 96-10, FCC 97-335 (rel. Sept. 24, 1997) (Order). Classic argues that the Commission's unwillingness to enforce the express directives of section 253(a) of the Communications Act, as amended, and its own prior Classic Telephone Preemption Order, improperly condones the Cities' violations of law in direct contravention of Congressional intent. Classic urges the Commission to reconsider its Order and direct the Cities to issue Classic a franchise immediately or preempt the Cities' requirements and find that Classic has authority to offer telecommunications services in the Cities. The Cities seek clarification of the Commission's Order or, in the alternative, reconsideration. The Cities contend that the Commission's Order reflects a significant factual error and that the Order fails to consider and analyze legal arguments raised by the Cities. The Cities also challenge certain representations made by Classic in this proceeding. Interested parties are to file comments on the petition for reconsideration filed by Classic and the petition for clarification or alternatively reconsideration filed by the Cities on or before December 8, 1997, and reply comments by December 23, 1997, with the Secretary, FCC, 1919 M Street, N.W., Washington, D.C. 20554.
