Washington, D.C. 20554 DA 97-2086 EXPEDITED PLEADING CYCLE ESTABLISHED FOR PRIMECO'S MOTION FOR STAY OF ENFORCEMENT OF RATE INTEGRATION REQUIREMENTS AS APPLIED TO CMRS PROVIDERS CCB/CPD 97-54 Released: September 25, 1997 Comments: September 29, 1997 On September 23, 1997, PrimeCo Personal Communications, LP ("PrimeCo") filed a motion for stay of enforcement of Section 64.1801 of the Commission's Rules, 47 C.F.R. 64.1801, pending reconsideration of the Commission's Rate Integration Reconsideration Order. PrimeCo seeks a stay of the Rate Integration Reconsideration Order to the extent that it extends application of rate integration requirements to Commercial Mobile Radio Service Carriers ("CMRS") carriers and to carriers which they control or own. PrimeCo states that a stay of enforcement of Section 64.1801 as applied to CMRS would permit the Commission to remedy alleged procedural infirmities and develop a record upon which it may resolve implementation issues of the integration and affiliate rules to the extent they apply to the CMRS industry. PrimeCo states that the Commission, at a minimum, should stay enforcement of the affiliation rules, which it maintains may require CMRS providers to engage in unlawful price fixing and otherwise violate the Commission's pro-competition policies. The rules adopted in the Rate Integration Reconsideration Order become effective on October 3, 1997. Interested parties may file comments on PrimeCo's petition no later than September 29, 1997. In light of the October 3, 1997, effective date, the Commission is not establishing a filing period for reply comments. When filing comments, please reference the internal file number: CCB/CPD 97-54. An original and four copies of all comments and replies must be filed in accordance with Section 1.51 (c) of the Commission's Rules, 47 C.F.R.  1.51(c).
