WASHINGTON, D.C. 20554 DA 97-1815 News media information 202/418-0500 Fax-On-Demand 202/418-2830 Internet: http://www.fcc.gov ftp.fcc.gov Released: August 22, 1997 Southwestern Bell Telephone Company Files Application for Review of Confidentiality Order Pleading Schedule Established CCB/CPD 97-45 COMMENTS: September 2, 1997 REPLY COMMENTS: September 9, 1997 On August 1, 1997, Southwestern Bell Telephone Company (SWBT) filed an Application for Review (Application) of an order granting in part and denying in part SWBT's request for confidential treatment of cost support data filed in support of SWBT's Transmittal No. 2647. SWBT alleges that if its cost support data is subject to the protective order set forth in the Order, it will suffer serious and irrevocable harm. According to SWBT, the Common Carrier Bureau exceeded its authority when it imposed the standard protective order approved in the Streamlined Tariff Filing Order to a non- streamlined tariff filing. SWBT's Application also alleges that the Order effectively eliminates SWBT's right to file its confidential information under the exemptions to the Freedom of Information Act. SWBT also argues that the provisions of the protective order do not adequately protect either SWBT or its vendors, which may have separate disclosure agreements with SWBT. Further, SWBT argues that a protective order should not be imposed prior to the resolution of SWBT's Petition for Reconsideration of the Streamlined Tariff Filing Order, and the Notice of Inquiry and Notice of Proposed Rulemaking examining the Commission's current policy concerning the treatment of confidential information submitted to the Commission. Interested parties may file comments on SWBT's Application for Review no later than September 2, 1997. Reply comments may be filed no later than September 9, 1997. An original and four copies of all comments must be filed in accordance with Section 1.51(c) of the Commission's Rules, 47 C.F.R.  1.51(c).
