Preliminary Matters X 4 x< Section 271(d)(3) states that "[t]he Commission shall not approve the authorization requested in x}an application . . . unless it finds" three specified conditions to be met. We expect that a section x"271 application, as originally filed, will include all of the factual evidence on which the applicant xwould have the Commission rely in making its findings thereon. In the event that the applicant xsubmits (in replies or ex parte filings) factual evidence that changes its application in a material xcrespect, the Commission reserves the right to deem such submission a new application and start xthe 90-day review process anew. All factual assertions made by any applicant (or any commenter) must be supported by credible evidence or will not be entitled to any weight. xBecause the statute affords us only 90 days to review the application, we encourage the applicant xto meet with likely objectors in order to attempt to narrow the issues in dispute. As noted in xlSection C of this Public Notice, we require that either the application itself or a supplemental xstatement filed within five days after the application contain a signed statement that describes xefforts that the applicant has made to narrow the issues in dispute and the results of those efforts. State Commission and Department of Justice Written Consultations xMany State commissions have already commenced proceedings to examine Bell company xpcompliance with section 271 or portions thereof. In light of this fact and in light of the shortness xyof the 90day period for deciding a section 271 application, we require that the relevant State xIcommission file any written consultation not later than approximately 20 days after the issuance xVof the Initial Public Notice. The specific due date for the State's written consultation will be set x<forth in the Initial Public Notice. The relevant State commission shall also follow the applicable procedures outlined in section A of this Public Notice. xpAny written consultation by the Department of Justice (which, by the Act's express terms, must x}become part of the record) must be filed not later than approximately 35 days after the issuance X 4 x/of the Initial Public Notice. The specific due date for the Department's written consultation will xbe set forth in the Initial Public Notice. Such replies are limited to 35 pages and will be due approximately 45 days x"after the Initial Public Notice is issued. The specific due date for replies will be set forth in the xhInitial Public Notice. Reply comments may not raise new arguments that are not directly xresponsive to arguments other participants have raised, nor may the replies be repetitive of x}arguments made by that party in the application or initial comments. "Ԍ NEWS January 2, 1997 STATEMENT OF CHAIRMAN HUNDT REGARDING AMERITECH'S FILING TO PROVIDE IN-REGION LONG DISTANCE SERVICES IN MICHIGAN Ameritech's filing for in-region long distance entry opens a new chapter in the implementation of the Telecommunications Act of 1996. The law places on the Bell company in each state the burden of proving that it has met the law's requirements for entering the long distance market in that state. The more than 4,000 pages of confidential and non-confidential information in Ameritech's initial filing for Michigan reveal the importance and difficulty of the issues. These entry applications are highly concentrated litigations and they will press our thin resources very hard. But we guarantee a fair decision on Ameritech's application -- approval or disapproval, with or without conditions -- within the 90-day period set by Congress. To meet this deadline and assure fairness to all, we must insist, however, that all parties literally and completely comply with our briefing order, set forth in Public Notice, FCC 96-469, and attached hereto. We will give substantial weight to the Department of Justice filing, as the law requires, and we will be very attentive to the filing by the Michigan Public Service Commission. -FCC- ""x
