Car. Bur., January 11, 1995) (Waiver Order). In the Waiver Order, the  xBureau authorized the Bell Operating Companies (BOCs) to provide, on an interim basis,  R- xenhanced services on an integrated basis subject to certain restrictions in light of the  xrecent court decision from the United States Court of Appeals for the Ninth Circuit,  R- xCalifornia v. FCC, 39 F.3d 919 (9th Cir. 1994), which vacated the BOC Safeguards  R-Order.  RQ-  x ITAA states that under the regulatory regime adopted in Computer II, the BOCs  xwere required to offer enhanced services through fully separate subsidiaries. ITAA states  R#- xthat in Computer III, the Commission allowed the BOCs to offer enhanced services on  xan integrated basis, provided that the BOCs implemented satisfactory Open Network  R- xArchitecture plans. ITAA argues that the California III decision vacated the Computer III  x^rules, and that the Bureau should evaluate the BOCs' waiver request under the  R-Computer II requirements.  R-  NxOppositions to this Petition must be filed by March 6, 1995, and Replies to an  R - xOpposition must be filed by March 15, 1995.
