DA 95-346 PLEADING CYCLE ESTABLISHED FOR COMMENTS AND REPLIES ON ITAA'S PETITION FOR RECONSIDERATION OF INTERIM WAIVER FOR BOC'S PROVISION OF ENHANCED SERVICES Released: February 24, 1995 On February 10, 1995, the Information Technology Association of America (ITAA) petitioned the Commission for reconsideration of the Common Carrier Bureau's Order, Bell Operating Companies' Joint Petition for Waiver of Computer II Rules, MO&O, DA 95-36 (Com. Car. Bur., January 11, 1995) (Waiver Order). In the Waiver Order, the Bureau authorized the Bell Operating Companies (BOCs) to provide, on an interim basis, enhanced services on an integrated basis subject to certain restrictions in light of the recent court decision from the United States Court of Appeals for the Ninth Circuit, California v. FCC, 39 F.3d 919 (9th Cir. 1994), which vacated the BOC Safeguards Order. ITAA states that under the regulatory regime adopted in Computer II, the BOCs were required to offer enhanced services through fully separate subsidiaries. ITAA states that in Computer III, the Commission allowed the BOCs to offer enhanced services on an integrated basis, provided that the BOCs implemented satisfactory Open Network Architecture plans. ITAA argues that the California III decision vacated the Computer III rules, and that the Bureau should evaluate the BOCs' waiver request under the Computer II requirements. Oppositions to this Petition must be filed by March 6, 1995, and Replies to an Opposition must be filed by March 15, 1995.
