(The Furst Group) filed a formal complaint with  X - xthe Commission against AT&T Corp. (AT&T) regarding AT&T Contract Tariff No. 374.h p+ XO-ԍ The Furst Group, Inc. v. AT&T Corp., File No. E9472. h On  xJanuary 11, 1995, AT&T filed Contract Tariff Transmittal No. 2952, seeking to amend Contract  xTariff No. 374. On January 17, 1995, The Furst Group filed a petition to reject or, in the alternative, suspend Contract Tariff Transmittal No. 2952.  Xc-  |xUnder Section 1.1208(c)(1)(ii)(B) of the Commission's rules,Oc{p+ X-ԍ 47 C.F.R.  1.1208(c)(1)(ii)(B). O The Furst Group's formal  XL- xcomplaint, pursuant to Section 208 of the Communications Act,=L,p+ X)-ԍ 47 U.S.C.  208.= is a restricted proceeding in  X5- xwhich ex parte presentations are prohibited. Under Subsection 1.1204(a)(6) of the Commission's  X - xrules,F p+ X-ԍ 47 C.F.R.  1.1204(a)(6).F however, no ex parte restrictions would apply to the tariff proceeding on Contract Tariff Transmittal No. 2952.   xWe believe that the public interest in an expeditious resolution of this tariff dispute would  xbe best served by ensuring that communications related to the tariff proceeding continue with a  xminimum of disruption. Yet, because the tariff and complaint proceedings appear to involve  xcommon issues and parties, we believe that this interest must be balanced against the public interest in maintaining the formal complaint process as a private adjudicatory proceeding.
