This Order addresses a petition of Roseville Telephone Company (RTC) requesting an extension of time to implement local number portability (LNP) in the Sacramento, California Metropolitan Statistical Area (MSA). 2. In a series of orders, the Common Carrier Bureau (Bureau) granted a number of petitions for extension of the LNP deployment schedule based on the change of LNP administrator in the Southeast, Western, and West Coast regions. In addition, the Bureau granted several extensions based on certain technical problems. A brief discussion of LNP and the effects occasioned by the change of LNP administrator may be found in the Phase I Extension Order. 3. RTC is an incumbent local exchange provider (LEC) providing wireline service in the Sacramento MSA. In its petition, RTC requests an extension of nineteen days from September 30, 1998 to October 19, 1998 to implement LNP in Sacramento. The purpose of the delay is to permit RTC to complete inter-carrier LNP testing and to align RTC's implementation efforts with those of Pacific Bell, the incumbent local exchange carrier (LEC). 4. Under section 1.3 of the Commission's rules, waivers may be granted "if good cause therefor is shown." The U.S. Court of Appeals for the District of Columbia Circuit concluded that a waiver may be granted if "special circumstances warrant a deviation from the general rule and such a deviation will serve the public interest." As we did in the previous LNP extension orders, we find that special circumstances were created as a result of the change in LNP administrator that warrant a deviation from the scheduled implementation date for Phase IV. Accordingly, we grant RTC an extension until October 19, 1998 to implement LNP in the Sacramento MSA. 5. IT IS THEREFORE ORDERED, pursuant to sections 1.3 and 52.23(e) of the Commission's rules, 47 C.F.R.  1.3 and 52.23(e), and by authority delegated in sections 0.91 and 0.291 of the Commission's rules, 47 C.F.R.  0.91 and 0.291, that RTC's Petition for Waiver is GRANTED, thereby extending the date for RTC's implementation of LNP as described in this Order.
