                           SECOND ORDER

By the Chief, Network Services Division, Common Carrier Bureau: 


     1.   On August 31, 1998, the Silver Star Telephone Company (Silver Star) filed a Request
for Emergency Extension of Waiver of the Four-Digit Carrier Identification Code (CIC)
Implementation Schedule.  Silver Star is an incumbent local exchange carrier headquartered in
Freedom, Wyoming, serving approximately 3,000 access lines in Western Wyoming and eastern
Idaho, and was previously granted a waiver of the Commission's CIC implementation schedule.  In
its original Petition for Waiver, Silver Star "demonstrate[d] the special circumstances meriting a
waiver of the January 1, 1998 conversion deadline," and we granted Silver Star an extension until
August 31, 1998.  

     2.   In its Emergency Request, Silver Star disclosed that all software and equipment
changes necessary to comply with the August 31, 1998 deadline were completed, except for the
trunking between its host office in Freedom, Wyoming and its remote office in Irwin, Idaho.  Without
the trunking, the cutover cannot occur because subscribers working out of the remote office would
be denied connectivity to the network beyond Irwin, which is provided by the host office.  Silver Star
claimed that it placed the service order for trunking with US West on July 2, 1998, and US West
responded with a due date of August 19, 1998, well in advance of the August 31, 1998 deadline. 
On August 18, 1998, US West informed Silver Star that due to the work stoppage underway at US
West, the service order would not be completed by the due date of August 19, 1998.  US West did
not provide Silver Star with a new due date.  As a result, Silver Star asked for an extension until
thirty days beyond the date that the US West work stoppage ends.
 
     3.   On September 3, 1998, US West confirmed the assertions made by Silver Star in its
Emergency Request, that the work stoppage caused US West to miss the August 19, 1998 due date. 
Since the work stoppage ended on September 1, 1998, US West established September 30, 1998 as
the new date to install the trunk lines that will connect Silver Star's host office in Freedom, Wyoming,
with its remote office in Irwin, Idaho. 

     4.   An applicant for waiver must demonstrate that special circumstances warrant a
deviation from the general rule and that such deviation will serve the public interest.  We conclude
that Silver Star has met this burden, and that the US West work stoppage, an occurrence  beyond
Silver Star's control, prevented Silver Star from complying with the Commission's deadline for four-
digit CIC conversion.  We note, however, that the original US West service order due date of August
19, 1998, allowed Silver Star two weeks to complete final preparations for the cutover of its
subscribers to the new network, which was to occur no later than August 31, 1998.  Accordingly, we
will add two weeks to US West's new installation date, so that Silver Star can perform a flawless
cutover for the benefit of its subscribers.  We also require Silver Star to file a report with the Network
Services Division, by October 23, 1998, with the status of the cutover allowing four-digit FGD CIC
functionality in the Irwin, Idaho remote office via the Freedom, Wyoming host office.

     5.    IT IS ORDERED, pursuant to Section 1.3 of the Commission's rules, 47 C.F.R. 
1.3, and authority delegated in Section 0.91 of the Commission's rules, 47 C.F.R.  0.91, and Section
0.291 of the Commission's rules, 47 C.F.R.  0.291, that Silver Star Telephone Company's Request
for Extension of Waiver of the Four Digit Carrier Identification Code (CIC) Implementation Schedule
is GRANTED until October 19, 1998, subject to the conditions stated herein.
