Specifically, ALTS maintains that these states have held that"j ,l(l(,,D"  S- xincumbent local exchange carrier (ILECs) must pay reciprocal compensation  yOh-  0#C\  P6Q/P#э xReciprocal compensation is an arrangement between two carriers that "provide[s] for the mutual and  x,reciprocal recovery by each carrier of costs associated with the transport and termination on each carrier's network  {O- xwfacilities of calls that originate on the network facilities of the other carrier." 47U.S.C.252(d)(2)(A)(i). See also  x47 U.S.C. 251(b)(5) (requiring LECs to establish reciprocal compensation arrangements for the transport and termination of telecommunications). when they exchange this  S- xtype of traffic with competitive local exchange carriers (CLECs).m z yO-#X\  P6G;/P#э xALTS Petition at 9.m Further, ALTS argues that Commission  xprecedent holds that ISPs are end users, not telecommunications carriers, and therefore GTE's DSL service  Sg-offering tariff cannot constitute local exchange access under Part 69. g  {O -#C\  P6Q/P#э xALTS Petition at 10. See also AOL Petition at 3.  S- ` ~x5.` ` Several parties contend that a DSL call terminates at the point where the call reaches an  S- xISP interconnected to GTE. {O -#C\  P6Q/P#э xSee ALTS Petition at 3; Focal and ICG Petition at 1. For example, ALTS argues that the telecommunications portion of the DSL  x\call terminates at the point where the call reaches an ISP interconnected to GTE because ISPs are end  xusers, and that any subsequent information services provided by the ISPs are irrelevant in determining the  S5- x"jurisdictional end points."m5.  yO-#X\  P6G;/P#э xALTS Petition at 9.m GTE's DSL tariff, therefore, should be subject to state ratemaking authority.  xmALTS also contends that any change in the states' authority should be done in the context of a  S-rulemaking.c  {O--#C\  P6Q/P#э xId.c  Si - ` `x6.` ` Several parties also contest GTE's characterization of the service as an access service.i P  {OY-#X\  P6G;/P#э xSee, e.g., Focal and ICG Petition at 2; CCTA Petition at 4.  x.They argue that GTE's DSL service is offered only to ISPs interconnected to GTE wire centers, and not  S - xto telecommunications carriers.n  yO-#C\  P6Q/P#э xALTS Petition at 10.n Focal and ICG argue that, in order for a service to be classified as an  xzaccess service, the service must be an offering of access to telephone exchange services or facilities for  xthe purpose of origination and termination of telephone toll service. Focal and ICG contend that, because  xthe service provided by ISPs is not telephone toll service, GTE's DSL service will not terminate in a  S7-telephone toll service and therefore is not an access service.7r {OI!-#C\  P6U/P#э xFocal and ICG Petition at 2. See also CCTA Petition at 4.  S- ` x7.` ` Northpoint, in an ex parte presentation, raised another jurisdictional argument. {Ou$-#X\  P6G;/P#э xNorthpoint Ex Parte Presentation to Jane E. Jackson et al. on June 23, 1998.  xNorthpoint contends that data CLECs could be subject to a price squeeze unless regulators review both  xGTE's retail DSL rates and GTE's wholesale charges for unbundled network elements (UNEs) used by  xcompetitors to provide their own DSL services. Northpoint argues that the Commission does not have"9,l(l(,," the UNE cost data needed to conduct the necessary analysis because UNEs are tariffed at the state level,  xwhile GTE is tariffing retail DSL services at the federal level. This allows, according to Northpoint, the  xpossibility that cost data submitted at the federal level will be significantly different than the cost data  xsubmitted at the state level. Northpoint, therefore, argues that the Commission should consider deferring the retail tariffing of DSL services to the states, to ensure consistent tariff review.  S-x 3.` ` Reply  Sh- ` x8.` ` GTE contends that its DSL service is properly tariffed at the federal level. It argues that  xInternet traffic is primarily interstate in nature, and that the ISP connects end users to information both  S- x.locally and worldwide. {Oj -  /#C\  P6Q/P#э xGTE Reply at 8, relying on American Civil Liberties Union v. Reno, 929 F.Supp 824, 830849 (E.D. Pa.  {O4 -1996), affirmed 177 S.Ct. 2329 (1997). GTE contends that "it is the nature of the communication itself rather than the  S- xphysical location of the technology that determines the jurisdictional classification of a service."$ {O -#C\  P6Q/P#э xGTE Reply at 8, citing New York Telephone Company v. FCC, 631 F.2d 1059, 1066 (2nd Cir. 1980). GTE  xstates that the Commission also has recognized that, even where a user's Internet destination is local or  Si -intraLATA, "there is no existing mechanism" to support jurisdictional segregation of traffic.i  {O-  #C\  P6Q/P#э xGTE Reply at 8 (citing from Digital Tornado: The Internet and Telecommunications Policy, OPP Working Paper (March 1997) at 45).  S - ` x9.` ` GTE also argues that its DSL service offering is part of "one continuous transmission  S - xpath," originating at the end user's site and terminating at the Internet servers accessed.i  yO-#X\  P6G;/P#э xGTE Reply at 9.i It should not  xObe viewed, argues GTE, as one local call terminating at the ISP's location, followed by another  Sj- xtransmission from the ISP to the Internet.lj {O-#C\  P6Q/P#э xId. at 910.l GTE argues that the Commission has already rejected a  S7-bifurcated jurisdictional analysis in the Memory Call Order.(72  {O -  k#C\  P6Q/P#э xPetition for Emergency Relief and Declaratory Ruling Filed by the BellSouth Corporation, Memorandum  {O-Opinion and Order, 12 FCC Rcd 1619 (1992) (Memory Call Order).(  S- ` x10.` ` GTE also points out that the ISP access charge exemption would not be necessary if the  S- xtraffic were not jurisdictionally interstate.i  yO-#C\  P6U/P#э xGTE Reply at 9.i GTE states that there is support for its jurisdictional position  Sl- xyin the Access Charge Reform Order, which states: "[A]lthough information service providers (ISPs) may  xuse incumbent LEC facilities to originate and terminate interstate calls, ISPs should not be required to pay  S-interstate access charges." {O#-  #C\  P6Q/P#э xGTE Reply at 9 (citing Access Charge Reform, First Report and Order, 12 FCC Rcd 15982 at 1613116132  {O$-(1997) (Access Charge Reform Order)).  S- ` 2x11.` ` GTE further argues that its DSL service offering is an access service under section 69.2(b)  xof the Commission's rules, which defines access service as "includ[ing] services and facilities provided"nz,l(l(,,"  S- xfor the origination or termination of any interstate or foreign telecommunication."q yOh-#C\  P6Q/P#э x47 C.F.R. 69.2(b).q The difference  xjbetween GTE's DSL service offering and traditional dialup access services using standard business lines,  xzstates GTE, is that its service is a dedicated offering. It is, according to GTE, a special, not switched,  Sg- xaccess arrangement.jgX yO_-#C\  P6Q/P#э xGTE Reply at 10.j GTE maintains, therefore, that the state decisions cited by petitioners regarding  xreciprocal compensation for switched calls to ISPs are not relevant to the jurisdictional classification of GTE's DSL service offering.  S-x 4.` ` Discussion  S5- ` x12.` ` The threshold issue raised by GTE's tariff and the petitioners is whether GTE's DSL  xservice offering is an interstate service, properly tariffed at the federal level, or an intrastate service that  xshould be tariffed at the state level. We find that the record in this proceeding to date does not contain  xlsufficient information on which to decide this issue. We, therefore, designate for investigation the  xquestion whether GTE's DSL service offering is a jurisdictionally interstate service. We solicit comments  x.on the jurisdictional issues raised by GTE's DSL service offering and whether it should be tariffed at the  xstate or federal level. We also solicit comments on whether the Commission should defer to the states  S -the tariffing of retail DSL services in order to lessen the possibility of a price squeeze.  Sj- B.xUNBUNDLING OF DSL SERVICE OFFERING ELEMENTS  S-x 1.` ` Background  S- ` 3x13.` ` Section 251(c)(3) of the Act requires ILECs to provide requesting telecommunications  xzcarriers nondiscriminatory access to network elements on an unbundled basis at any technical feasible  S8- xzpoint on rates, terms, and conditions that are just, reasonable, and nondiscriminatory.8 {O- #X\  P6G;/P#э See Implementation of the Local Competition Provisions in the Telecommunications Act of 1996, CC Docket  {O-  No. 96-98, First Report and Order, 11 FCC Rcd 15499, 15612, 15658, paras. 218, 312 (1996) (Local Competition  {OT-  Order), aff'd in part and vacated in part sub nom. Section 251(c)(4) of the Act requires all ILECs to offer for resale  xany telecommunications service that the carrier provides at retail to subscribers who are not telecommunications carriers. " ,l(l(,,"Ԍ S- ` ԙx14.` ` Additionally, the Commission's Expanded Interconnection rules require the largest ILECs  xLto file tariffs with the Commission to offer collocation to parties, such as CLECs, that wish to terminate  S- xinterstate special access and switched access transport facilities.c! {O-#X\  P6G;/P#э xId.c Thus, a requesting carrier has the choice  xof negotiating an interconnection agreement pursuant to sections 251 and 252 of the Act for  xinterconnection, services, or network elements or taking tariffed interstate service under the Commission's  S- xExpanded Interconnection rules.n"Z {O-#X\  P6G;/P#э xId. at 15809. n Under the Commission's expanded interconnection rules, LECs are  S- xrequired to provide interconnection with special access services within 45 days of receiving a bona fide  S-request for such a service."# {O( -  =#X\  P6G;/P#э xExpanded Interconnection with Local Telephone Company Facilities, Memorandum and Opinion and Order,  {O -9 FCC Rcd 5154, 5180 (1994) (Virtual Collocation Order)."  S6-x 2.` ` Petitions  S- ` x15.` ` Petitioners have asserted that GTE's DSL service offering as tariffed violates section 251  xof the Act. Specifically, E*Spire and Intermedia assert that, if GTE is permitted to categorize DSL service  x as an exchange access service only, GTE could effectively succeed in removing DSL service from the  x=requirement under section 251(c)(4) of the Act that ILECs make their retail telecommunications services  S - xavailable for resale by competitors.$ H yO-#X\  P6G;/P#э xE*Spire Petition at 34; Intermedia Petition at 34. TCG asserts that the proposed bundling of DSL service with GTE's  xexisting frame relay system would preclude CLECs and other telecommunications carriers from  xinterconnecting their networks at any technically feasible point and would restrict CLECs' and their  Sk- xcustomers' ability to configure their interconnected systems as they see fit.l%k yO-#X\  P6G;/P#э xTCG Petition at 2.l Moreover, TCG asserts that,  xLto ensure that GTE does not violate its statutory obligations by discriminating against its competitors in  xtheir use of DSL services, the Commission must require that GTE make DSLsuitable loops available as  xunbundled elements to its competitors, including nondiscriminatory access to GTE's Operations Support  S- xSystems,l&h  yO-#X\  P6G;/P#э xTCG Petition at 5.l on the same terms and conditions as it uses them itself to make DSL services available to its own customers. x  S- ` x16.` ` MCI raises a related interconnection issue by asserting that the Commission's expanded  S- xinterconnection orders require that GTE's DSL loop and frame relay system be tariffed separately.l'  yOk!-#X\  P6G;/P#э xMCI Petition at 5.l MCI  xasserts that, by separately tariffing the frame relay service and DSL service, customers will be given the  Sm- xopportunity to purchase only the DSL loop.c(m  {O$-#X\  P6G;/P#э xId.c MCI notes that the Commission, in its Virtual Collocation  S;- xOrder, stated that "our expanded interconnection policy is designed to facilitate competition for special  xaccess and switched transport services, essentially by making it possible to buy only those LEC" (,l(l(,,"  S-transmission and distribution links that a customer wants.") {Oh-#X\  P6G;/P#э xMCI Petition at 5 (citing Virtual Collocation Order, 9 FCC Rcd 5154, 5159). x  S-x 3.` ` Reply  S4- ` x17.` ` In response to petitioners' claims, GTE asserts that it is complying fully with its  xinterconnection and unbundling obligations because it has provided and will continue to provide requesting  xtelecommunications carriers access to unbundled DSLconditioned loops in accordance with the  S- xrequirements of section 251(c)(3).j*Z yO -#X\  P6G;/P#э xGTE Reply at 22.j GTE disputes petitioners' resalerelated claims. GTE asserts that the  xDSL service offering is an access service and thus is not subject to the resale requirements of section  S5- x251(c)(4).c+5 {O -#X\  P6G;/P#э  xId.c In response to MCI's expanded interconnection concern, GTE asserts that the issue is not  S- xLripe for review. GTE notes that expanded interconnection tariffs must be filed within 45 days of a bona  S-fide request for such access and asserts that it has not received such a request.,| {O-#X\  P6G;/P#э xGTE Reply at 31. S -  Sk -x4.` ` Discussion  S - ` x18.` ` We do not designate for investigation issues arising under sections 251 and 252 or the  xCommission's expanded interconnection rules in this section 204(a) proceeding. Although we do not  x>designate these issues here, we recognize that CLECs have significant concerns regarding GTE's DSL  xoffering and its relation to a requesting carrier's rights under section 251(c) of the Act and the Commission's expanded interconnection rules.  S- ` x19.` ` We note that, by using its network to provide DSL service, GTE is subject to the section  x251 obligations. The Commission recently determined that advanced services, including DSL services,  Sm- x.are telecommunications services subject to the obligations of section 251(c).-\m {O-  #C\  P6Q/P#эxDeployment of Wireline Services Offering Advanced Telecommunications Capability, CC Docket Nos. 98 x147, 9811, 9826, 9832, 9878, 9891, and CCB/CPD No. 9815, Memorandum Opinion and Order, and Notice of  {O-Proposed Rulemaking, FCC 98188, at para. 32 (rel. Aug. 7, 1998) (Wireline Advanced Services Order/NPRM). In the Wireline Advanced  S;- xServices Order/NPRM, the Commission stated that the interconnection obligations of section 251(c)(2)  S - xapply to DSL services offered by an ILEC.r. 2  {O-#C\  P6Q/P#эxId. at paras. 4649.r In addition, the Commission determined that the facilities  xand equipment used by ILECs to provide advanced services are network elements and are subject to  S- xsection 251(c)./  {O#-#C\  P6Q/P#эxWireline Advanced Services Order/NPRM, FCC 98188 at para. 18. Similarly, DSL services offered by ILECs are subject to the resale requirements of  Sp- xsection 251(c)(4).0\pV  {Of%-  #C\  P6Q/P#эxId. at para. 30. In the Local Competition Order, the Commission stated that exchange access services are  xnot subject to the resale requirements of section 251(c)(4), "because the vast majority of the purchases of such  {O&- xservices are telecommunications carriers, not end users." In the Wireline Advanced Services Order/NPRM, the Commission tentatively concluded, and sought  xZcomment on its tentative conclusion, that to the extent advanced services, including DSL services, are exchange  x>access services, such services are fundamentally different from the exchange access services to which the  {O- xCommission referred in the Local Competition Order. Wireline Advanced Services Order/NPRM at paras. 188189.  xZThe Commission is therefore considering the application of section 251(c)(4) to advanced services in a separate proceeding. We note that GTE has stated that its DSL service is to be offered on an unbundled"pD0,l(l(,,"  x/basis so that CLECs may interconnect their networks with GTE's ADSL network at any technically  S- x.feasible point.j1D yO-#X\  P6G;/P#э xGTE Reply at 22.j If it becomes apparent that GTE is not meeting these obligations and competitors have  xzdifficulty negotiating interconnection agreements, obtaining access to unbundled network elements, or  xpurchasing telecommunications services for resale pursuant to sections 251 and 252, competitors may seek mediation pursuant to section 252(a)(2) or arbitration pursuant to section 252(b).
