In our June 29, 1998 Order, we extended the deadline for filing with the Federal Communications Commission (Commission), tariffs for intrastate payphone service offerings in North Carolina, together with supporting documentation, for all payphone services that had not been determined by the North Carolina Utilities Commission (North Carolina Commission) to comply with the requirements of Section 276 and the Commission's implementing rules. As indicated in that Order, the deadline was extended in order to allow the North Carolina Commission time to issue a decision on a pending motion for reconsideration filed by BellSouth Telecommunications, Inc. (BellSouth), on behalf of itself and other North Carolina telephone companies (collectively North Carolina Telcos). In the BellSouth Motion for Reconsideration, BellSouth and the North Carolina Telcos requested that the North Carolina Commission reconsider its May 15, 1997 Order directing North Carolina local exchange carriers (LECs) to file revised rates and supporting data with the Commission. 2. We stated, in our June 29, 1998 Order, that if the North Carolina Commission resolved the BellSouth Motion for Reconsideration and reversed the decision reached in its May 15, 1997 Order, we would rescind our March 20, 1998 Order, which required specific incumbent LECs in North Carolina to file with the Commission by May 1, 1998, tariffs for intrastate payphone service offerings, together with supporting documentation. We also stated that we would rescind our April 30, 1998 Order, and our June 29, 1998 Order, which respectively extended the deadline for filing with the Commission to July 1, 1998, and August 1, 1998. On July 10, 1998, the North Carolina Commission issued an Order granting the BellSouth Motion for Reconsideration and reversing its May 15, 1997 Order. 3. Accordingly, IT IS ORDERED, pursuant to Section 276 of the Communications Act of 1934, as amended, 47 U.S.C.  276, and through authority delegated pursuant to Sections 0.91 and 0.291 of the Commission's Rules, 47 C.F.R.  0.91, 0.291, that the North Carolina Utilities Commission Order Dismissing and Directing Filings, Order, DA 98-548, (Com. Car. Bur., rel. March 20, 1998), the North Carolina Utilities Commission Order Dismissing and Directing Filings, Order, DA 98-830, (Com. Car. Bur., rel. April 30, 1998), and the North Carolina Utilities Commission Order Dismissing and Directing Filings, Order, DA 98-1296, (Com. Car. Bur., rel. June 29, 1998) are RESCINDED.
