On November 10, 1997, GoCom International (GoCom) filed the above-captioned complaint against MCI Telecommunications Corporation (MCI), alleging violation of Section 201(b) of the Communications Act of 1934, as amended. GoCom claimed that MCI acted unreasonably when it failed to provide GoCom with products and services capable of allowing GoCom to operate as an internet service provider. 2. On May 26, 1998, GoCom and MCI jointly filed a motion requesting that the Commission dismiss GoCom's complaint with prejudice. In the motion, the parties state that they "have reached an agreement that advances their interests and avoids a costly and time- consuming evidentiary hearing or other resolution process held before the Commission." 3. We are satisfied that granting the jointly filed motion to dismiss GoCom's complaint will serve the public interest by eliminating the need for further litigation and the expenditure of further time and resources by the parties and by the Commission. 4. Accordingly, IT IS ORDERED, pursuant to Sections 4(i), 4(j), and 208 of the Communications Act of 1934, as amended, 47 U.S.C. 154(i), 154(j), 208, and the authority delegated under Sections 0.91 and 0.291 of the Commission's rules, 47 C.F.R. 0.91, 0.291, that the parties' Joint Motion To Dismiss The Complaint With Prejudice IS GRANTED. 5. IT IS FURTHER ORDERED that the above-captioned complaint is DISMISSED WITH PREJUDICE and that this proceeding is TERMINATED. FEDERAL COMMUNICATIONS COMMISSION Kurt A.
