On August 6, 1997, the Commission released a decision granting  xJrequests to modify LATA boundaries to permit three independent telephone company (ITC) exchanges in Texas to  xchange LATA association for purposes of improving service to subscribers. The Commission stated that a carrier  xwill be deemed to have made a prima facie case supporting grant of a proposed association change if the petition:  x(1) states that the association change is necessary because of planned upgrades to the ITC's network or service that  x<will require routing traffic through a different BOC LATA; (2) involves a limited number of access lines; and (3)  xincludes a statement from the affected BOC(s) requesting a LATA modification, pursuant to section 3(25) of the Act,  x to permit the change in association. DISCUSSION  Xt- `  x5.` ` Ameritech's petition proposes to establish a message rate, twoway ELCS.  x=Message rate service is the only type of local service provided by Ameritech to its Wisconsin  X.- xZcustomers.Z.0 ~ yO-  ?ԍx"According to AmeritechWisconsin personnel, message rate service is the only type of local service  x-provided by Ameritech in Wisconsin. All local exchange customers in Wisconsin receive message rate service."  {O-See letter from Richard L. Hetke, Ameritech, to Alan Thomas, Network Services Division ( January 8, 1998).  The request is accompanied by: (1) an order confirming state approval of the limited  xLATA modification requested; (2) a statement that only traditional local service is proposed; (3)  xa community of interest finding by the Wisconsin Public Service Commission; (4) usage data;  xand (5) a statement that the petition involves 10 access lines. The brief descriptions of the basis  X- xfor the requested ELCS reveal that many community services (such as hospitals, doctors offices,  xschools, stores, public transportation facilities, and government offices) are located in a nearby  xcommunity in the adjacent LATA, and that making interLATA toll calls for such services generates significant expenses for residents.  X - ` x6.` ` As we stated in the July 1997 Order, granting an ELCS petition removes the  X - xyproposed route from the competitive interexchange market.G R ~ {O-ԍxId. at para. 18.G Some LATA modifications could  x-reduce the incentive created by Section 271 of the Act for BOCs to open their local exchange and  X- xjexchange access markets to competition.:~ {O! -ԍxId.: The effect on competition was an important reason  xLin the District Court granting flatrated ELCS requests while opposing, for example, optional or  x-measured rate ELCS requests. Optional or measured rate ELCS requests, however, were opposed  X#- xzby the District Court where the request would introduce such plans into the expanded local  X- xzcalling area as contrasted with requests where such plans were part of the existing levels of  X- xservice.^^v~ {O&-  ԍxSee Bell AtlanticVirginia, Inc. Petitions for Limited Modification of LATA Boundaries to Provide  {O&- xhExpanded Local Calling Service (ELCS) at Various Locations, Memorandum Opinion and Order, File No. NSDLM {O'- x9733, DA 9895 (rel. Jan. 20, 1998). The District Court approved ELCS requests where flatrated, measured rate,"',l(l('" message rate, and other types of services were part of the existing services provided to customers.^ In the present case, Ameritech only offers message rate service in Wisconsin. Given"X,l(l(,,"  X- xthis fact, and that Ameritech's petition involves only ten access lines, we find that the proposed  xLATA modification will not have a significant anticompetitive effect on the interexchange market  xor on Ameritech's incentive to open its local exchange and exchange access markets to competition.  XQ- ` T Px7.` ` We conclude that, in the petition, the community's need for the proposed ELCS  xroutes outweighs the risk of potential anticompetitive effects. Granting Ameritech's petition  xserves the public interest by permitting a minor LATA modification in a case where such  x-modification is necessary to meet the needs of local subscribers and will not have any significant  xeffect on competition. Accordingly, we approve Ameritech's petition for limited LATA  xmodification in order to provide message rate ELCS. The LATA is modified solely for the  xlimited purpose of allowing twoway, message rate local calling service between the specific  x=exchanges or geographic areas identified in the requests. The LATA is not modified to permit  xthe BOC to offer any other type of service, including calls that originate or terminate outside the  xspecified areas. Thus, message rate ELCS between the specified exchanges will be treated as  X - xiintraLATA, and the provisions of the Act governing intraLATA service will apply.
