Economy Lodging Systems ("ELS"),  x2formerly a defendant in this consolidated action, operated motels under the names "Knight's Inn", "Knight's Court",  xjand "Arborgate Inn" (collectively known as "Knight's Inn") and was responsible for procuring and managing their  x8telecommunications services. In the instant case, ELS sold the telecommunications management rights for all Knight's Inn hotels to Nassau, on or about April 5, 1991. LexNet Communications, Inc. ("USO")qX xP+%(  #]\  PCP#эUSO was responsible for equipment installation and programming, "branding" of operatorassisted calls,  xprovision of "tent cards" and customer service support, traffic reports, billing and collection, and filing of interstate and intrastate tariffs.q pursuant to Section 208 of the Communications Act of 1934," ,))??" This section gives "[a]ny person, any body politic or municipal organization, or State  x commission" the right to file a complaint with the Commission if the complainant believes that a common carrier has acted or failed to act in contravention of the Act or Commission rule or Order. alleging that defendants violated Sections 201(b)oe xP(#]\  PCP#э47 U.S.C.  201(b). o, 203kxe xP(#]\  PCP#э47 U.S.C.  203.k, and  S' x626(b)vh yO '#]\  PCɒP##]\  PCɒP#э47 U.S.C.  626. of the Act, and Section 64.704nvh yO '#]\  PCɒP#э47 C.F.R.  64.704.n of the Commission's rules. Nassau alleged, inter alia, that LCN  xviolated Section 201(b) by falsely representing that rates to be charged would be no higher than AT&T  xrates, and by billing and charging rates that were higher. Nassau further claimed that the defendants  x}together violated Section 201(b) by "conspiring to violate the Act" through marketing and providing  xoperator services without filing a tariff. On February 29, 1993, defendants separately filed Answers to  S'the Complaints denying that they had violated any provision of the Act or any Commission rule.  S' e 2.` ` On July 18, 1997, NCN, LNC, and USO (collectively "the defendants") filed the instant  x7Motion to Dismiss with Prejudice for Failure to Prosecute ("Motion to Dismiss"). Nassau did not oppose  xthe Motion to Dismiss. For the reasons set forth below, we grant the defendants' unopposed Motion to Dismiss.  S 'L@ II. DISCUSSION   S ' e 5\ 3.` ` The Motion to Dismiss must be considered in the light of the extended discovery  xproceedings that have occurred. Because of complex, disputed, and still unresolved discovery motions,  xcoupled with the sporadic and/or indifferent prosecution of the proceeding by the complainant and its  xfailure to complete its discovery undertakings, the instant complaints have been before the Commission  xfor over four years. On January 20, 1994, Nassau filed a motion to compel discovery. The defendants  xfiled an opposition to Nassau's motion to compel, contending that it was contrary to a staff letter ruling  S' xissued June 18, 1993, denying discovery on other than jurisdictional issues.p ( vh yO' " #]\  PCɒP#э#]\  PCɒP#Letter from Thomas D. Thus, Nassau's counsel of record was afforded  xthe opportunity to communicate with its client regarding the proposed July 18, 1997 status conference and  S" ' xits purpose, i.e., to discuss and resolve dormant discovery issues or any outstanding procedural matters  xthat might assist the parties in implementing an immediate resumption of active and effective prosecution  xof this case. The scheduled status conference was held in accordance with the written notice given the parties, but only counsel for the defendants attended. Although the defendants' Motion did not include a request to dismiss the portion of this  xconsolidated proceeding against Economy Lodging Systems ("ELS"), we take this opportunity to dismiss  xthe complaint against ELS on the same grounds as we dismissed the complaints against NCN, LNC, and USO.
