No. 1 ) Transmittal No. 966 SUSPENSION ORDER Adopted: June 11, 1997; Released: June 11, 1997 By the Chief, Competitive Pricing Division, Common Carrier Bureau: 1. On June 9, 1997, The Bell Atlantic Telephone Companies (Bell Atlantic) filed the above transmittal in two parts. In response to the Suspension Order released in this Docket, Part I of this transmittal advanced by one day the effective date of Bell Atlantic Transmittal No. 962 and implemented our one-day suspension of the effective date of that transmittal. This part became effective the day it was filed. 2. In Part II of this transmittal, Bell Atlantic proposes to adjust a rate that it states was incorrectly displayed in its earlier Transmittal No. 962. We find that the proposed rate adjustment in Part II of the above transmittal raises the same issues of lawfulness as Bell Atlantic Transmittal No. 962. Accordingly, we suspend Part II of the above transmittal for one day, institute an investigation of that part of the transmittal, consolidate that investigation with the pending investigation of Bell Atlantic Transmittal No. 962, and impose an accounting order. 3. Accordingly, IT IS ORDERED that, pursuant to Section 204(a) of the Communications Act of 1934, as amended, 47 U.S.C.  204(a), and Section 0.291 of the Commission's Rules, 47 C.F.R.  0.291, the rate adjustment to The Bell Atlantic Telephone Companies Tariff F.C.C. No. 1 filed under Transmittal No. 966 IS SUSPENDED for one day from the effective date and an investigation of that part of the transmittal IS INSTITUTEDand consolidated with the investigation initiated in the Suspension Order, DA 97-1149, released June 2, 1997, as corrected June 5, 1997. 4. IT IS FURTHER ORDERED that, pursuant to Section 204(a) of the Communications Act, as amended, 47 U.S.C.  204(a), The Bell Atlantic Telephone Companies SHALL KEEP ACCURATE ACCOUNT of all earnings, costs, and returns associated with the rate adjustment that is subject to this investigation, and of all amounts paid thereunder and by whom such amounts are paid. 5. IT IS FURTHER ORDERED that The Bell Atlantic Telephone Companies SHALL FILE tariff revisions within five business days from the release of this Order to accomplish this suspension. For these purposes, we waive Sections 61.56, 61.58, and 61.59 of the Commission's Rules, 47 C.F.R.  61.56, 61.58, and 61.59.
