No. 5) ORDER Adopted: May 5, 1997 Released: May 5, 1997 By the Chief, Competitive Pricing Division, Common Carrier Bureau: 1. On April 21, 1997, U S West filed Transmittal No. 837 to revise its Tariff F.C.C. No. 5. Transmittal No. 837, which is scheduled to become effective on May 6, 1997, proposes to offer an optional central office (CO) synchronization service for timing of interconnector - designated equipment. On April 30, 1997, U S West proposed revisions to Transmittal No. 837 by filing Transmittal No. 841. Transmittal No. 841 also is scheduled to go into effect on May 6, 1997. No petitions have been filed against this transmittal. 2. Transmittal No. 837 and Transmittal No. 841 raise the same issues regarding rate levels, rate structures, and terms and conditions of service as those identified in the Virtual Collocation Tariff Suspension Order. Therefore, Transmittal No. 837 and Transmittal No. 841 are suspended for one day, following the effective date, and will be subject to the investigation initiated in the Virtual Collocation Tariff Suspension Order. These transmittals will also be subject to an accounting order to facilitate any refunds that may later prove necessary. 3. Accordingly, IT IS ORDERED that, pursuant to Section 204(a) of the Communications Act of 1934, as amended, 47 U.S.C.  204(a), and Section 0.291 of the Commission's Rules, 47 C.F.R.  0.291, the physical collocation revisions to U S West Tariff F.C.C. No. 5, filed under Transmittal No. 837 and Transmittal No. 841, ARE SUSPENDED for one day from the effective date and an investigation of the referenced tariff transmittals ARE INSTITUTED. 4. IT IS FURTHER ORDERED that, pursuant to Section 204(a) of the Communications Act of 1934, as amended, 47 U.S.C.  204(a), U S West shall keep accurate account of all earnings, costs, and returns associated with the rates that are the subject of this investigation, and of all amounts paid thereunder and by whom such amounts are paid. 5. IT IS FURTHER ORDERED that U S West SHALL FILE tariff revisions within five business days of the release date of this Order to reflect this suspension. 6. IT IS FURTHER ORDERED that, for the above purposes, we waive Sections 61.56, 61.58, and 61.59 of the Commission's Rules, 47 C.F.R.  61.56, 61.58, and 61.59.
