INTRODUCTION 1.In this Order, we grant the local exchange carriers ("LECs") listed in the attached Appendix an extension from December 1, 1996, until December 23, 1996, to file tariffs offering Originating Line Screening ("OLS") services. II. BACKGROUND 2.In the Third Report and Order in CC Docket No. 91-35, the Commission required LECs to file federal tariffs offering certain OLS services no later than December 1, 1996. The OLS Order provided that LECs could make OLS services available either through flexible automatic numbering identification (Flex ANI) or a line information database (LIDB). The OLS Order further provided that a LEC could obtain a temporary waiver of the December 1, 1996, filing requirement if it demonstrated that it would not be "technically feasible or economically reasonable" to provide OLS services. III. PETITIONS AND COMMENTS 3.The LECs listed in the attached Appendix filed petitions and other pleadings seeking extension or waiver of the December 1, 1996, deadline to file tariffs offering OLS services. These petitioners contend variously that: an additional fixed amount of time, ranging from several months to over two years, is needed in order for the LEC to provide OLS; the LEC has chosen to use LIDB to provide OLS but it is unclear when, or if, its LIDB vendor will offer OLS capability; the LEC's LIDB provider has decided not to provide OLS and the LEC needs additional time to formulate plans; the LEC has not formulated plans to provide OLS; provision of OLS could be expensive for LECs that do not have digital end offices converted to equal access; and the Commission should determine that it is economically unreasonable to require a LEC to offer OLS until it receives a bona fide request to provide it. The requests for extension or waiver are opposed by several parties. IV. DISCUSSION 4.The petitions under review raise significant questions regarding the feasibility of complying with the Commission's requirement that LECs federally tariff OLS services on or before December 2, 1996. A brief extension will permit further consideration of these questions. Accordingly, we will grant an extension until December 23, 1996, for the LECs listed in the attached Appendix to file tariffs offering OLS services. The Common Carrier Bureau will issue a further ruling on the petitions prior to December 23, 1996. This extension will apply only to those LECs that have requested an extension or waiver. Other LECs continue to be required to comply with the tariff filing deadline established in the OLS Order. LECs that have requested an extension or waiver of the tariff filing deadline for some of their end offices remain required to file tariffs by December 2, 1996, offering OLS services from their remaining end offices. V. ORDERING CLAUSE 5. Accordingly, IT IS ORDERED, that the petitions seeking extension of the December 1, 1996, tariff filing deadline for OLS filed by the LECs listed in the attached Appendix ARE GRANTED to the extent discussed above.
