LETTER SEEKING CLARIFICATION OF RATE REGULATORY RULES FOR INSIDE WIRE
MAINTENANCE


     The Commission has received a request for clarification of our rules from Cole, Raywid and
Braverman, regarding the regulatory treatment of a 'whole house' inside wire maintenance plan.  Under the
'whole house' plan, a cable company would offer consumers inside wire maintenance for all home
communications lines, such as telephone, cable television and satellite.  Consumers that choose the 'whole
house' plan would pay a monthly fee for the service.  For consumers in markets that are subject to rate
regulation, and that do not choose to subscribe to the 'whole house' plan, the cable operator would continue to
provide transactional cable wire maintenance at the regulated 'hourly service charge' under 47 C.F.R.  67.923. 
Cole, Raywid and Braverman asks for clarification that the monthly fee for the 'whole house' plan would not
be subject to rate regulation.

     For purposes of our ex parte rules, this proceeding will be considered as non-restricted pursuant to
Section 1.1206 of the Commission's rules ("Permit-but-disclose proceeding").

     Parties may file responses to the Petition on or before September 20, and replies on or before
September 30.  Please place the case identifier, CSR-5424, on all filings.
