WASHINGTON, D.C. 20554 News media information 202/418-0500 Fax-On-Demand 202/418-2830 Internet: http://www.fcc.gov ftp.fcc.gov Report No. CS 97-23 CABLE SERVICES ACTION August 18, 1997 RATE REGULATION RULE CHANGES REQUIRING OMB APPROVAL EFFECTIVE AS OF AUGUST 13, 1997 On December 23, 1996, the Commission released an order (FCC 96-491, 11 FCC Rcd 20206 (1996)) revising its rate regulation rules in response to the decision of the court in Time Warner Entertainment Co. v. FCC, 56 F.3d 151 (D.C. Cir. 1995). This order, among other things, amended 47 C.F.R.  76.922 (Rates for the basic service tier and cable programming services tiers) and 76.913 (Assumption of jurisdiction by the Commission). Because they imposed new or modified information collection requirements, these particular rule changes could not become effective until approved by the Office of Management and Budget ("OMB") pursuant to the Paperwork Reduction Act of 1995, Pub. L. No. 104-13. OMB approved these rule changes on August 13, 1997. The Commission stated that it would publish a document establishing the effective date of the rule changes requiring OMB approval. See Implementation of the Cable Television Consumer Protection and Competition Act of 1992: Rate Regulation, 62 Fed. Reg. 6491 (Feb. 12, 1997). Accordingly, the Commission will publish a document in the Federal Register establishing August 13, 1997 as the effective date for the amendments to 47 C.F.R.  76.922 and 76.913. We note that the amendments to the rate regulation rules that did not require OMB approval became effective on March 14, 1997.
