WASHINGTON, D.C. 20554 DA 97-2354 News media information 202/418-0500 Fax-On-Demand 202/418-2830 Internet: http://www.fcc.gov ftp.fcc.gov CABLE SERVICES ACTION November 10, 1997 LEASED ACCESS INDECENCY RULE CHANGES REQUIRING OMB APPROVAL EFFECTIVE AS OF OCTOBER 29, 1997 On May 7, 1997, the Commission released an order (FCC 97-156, 12 FCC Rcd 5267 (1997)) revising its leased access indecency rules in response to the Supreme Court decision in Denver Area Educational Telecommunications Consortium v. FCC, 116 S. Ct. 2374 (1996). This order amended 47 C.F.R.  76.701 and 76.702. Because it imposed new or modified information collection requirements, these particular rule changes could not become effective until approved by the Office of Management and Budget ("OMB") pursuant to the Paperwork Reduction Act of 1995, Pub. L. No. 104-13. OMB approved these rule changes on October 29, 1997. The Commission stated that it would publish a document confirming the effective date and notifying parties that these rules have become effective. See Implementation of the Cable Television Consumer Protection and Competition Act of 1992: Indecent Programming and Other Types of Materials on Cable Access Channels, 62 Fed. Reg. 28371 (May 23, 1997). Accordingly, the Commission will publish a document in the Federal Register establishing October 29, 1997 as the effective date for 47 C.F.R.  76.701 and 76.702.
