On October 31, 1997, Time Warner Cable ("Time Warner") filed a complaint alleging that RCN-BecoCom, L.L.C. ("RCN") has violated its obligation as a certified open video system operator under Section 76.1503(b)(2) of the Commission's rules to provide information to interested video programming providers. Time Warner argues that RCN has improperly refused to provide information to Time Warner on the grounds that Time Warner is an in-region cable operator, and thus generally prohibited from becoming a video programming provider. Time Warner requests that the Commission order RCN to provide the information requested by Time Warner, and that, should Time Warner decide to pursue carriage on RCN's system, the Commission order RCN to provide channel capacity in a non-discriminatory manner. Time Warner also requests that the Commission provide such other relief as it deems necessary, including revocation of RCN's open video system certification. Pursuant to Section 76.1513(a) of the Commission's rules (47 C.F.R. 76.1513(a)), Time Warner's complaint must be resolved within 180 days of filing. RCN's answer, and the comments of interested parties, are due no later than December 8, 1997. Reply comments may be filed no later than December 29, 1997.
