WASHINGTON, D.C. 20554 DA 96-1755 News media information 202/418-0500 Fax-On-Demand 202/418-2830 Internet: http://www.fcc.gov ftp.fcc.gov CABLE SERVICES ACTION October 23, 1996 COMMISSION'S RULE PREEMPTING RESTRICTIONS ON TV, MMDS, and DBS ANTENNA PLACEMENT IS EFFECTIVE OMB CLEARS INFORMATION COLLECTIONS IN CS DOCKET 96-83 On August 6, 1996 the Commission released a Report and Order, Memorandum Opinion and Order, and Further Notice of Proposed Rulemaking in IB Docket No. 95-59 and CS Docket No. 96-83, to implement Section 207 of the Telecommunications Act of 1996. This Order adopted rule section 1.4000 and modified rule section 25.104 to preempt local restrictions that impair a viewer's ability to receive video programming signals over the air via direct broadcast satellite (DBS), broadcast television service (TVBS) or multichannel multipoint distribution service (MMDS, or wireless cable). The effectiveness of the rule was dependent on Office of Management and Budget (OMB) clearance of the paperwork requirements produced by this rule. On October 14, 1996, pursuant to the Paperwork Reduction Act, OMB acted on the Commission's request for approval of a revision of an information collection in this rulemaking. OMB approved this information collection, in OMB No. 3060-0707, with an expiration date of October 31, 1999. Accordingly, the Commission's rules Section 1.4000 and 25.104, as amended, became effective on October 14, 1996.
