In this Report and Order, we amend our rules to implement Section 301(j) of the Telecommunications Act of 1996 ("1996 Act"), which adds a new Section 623(a)(7) to the Communications Act of 1934, as amended. Section 301(j) of the 1996 Act requires that "[t]he Commission allow cable operators to aggregate, on a franchise, system, regional, or company level, their equipment costs into broad categories regardless of the varying levels of functionality of the equipment within each such broad category." That section also provides that "[s]uch aggregation shall not be permitted with respect to equipment used by subscribers who receive only a rate regulated basic service tier." To implement these rule changes, the Commission made alterations to the existing instructions for FCC Form 1205. The alterations to FCC Form 1205 were approved by the Office of Management and Budget on June 11, 1995.
